ORDINANCE NO. 92 151
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 25, HAWAII COUNTY CODE
1983, RELATING TO APPROPRIATION OF FUNDS TO NONPROFIT ORGANIZATIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Finding. The demand for additional funds for grants
and purchases of services by nonprofit organization has been on a
constant increase with no ceiling in sight. While the council is
sympathetic to the needs for more public health and welfare services
throughout our communities, these additional funds are being
provided at the expense of basic county services.
Article IX of the Constitution of the State of Hawaii clearly
places public health and welfare responsibilities on the State
government. Fiscal constraints mandate that the county reassess its
involvement in social programs and services.
The council finds that the time is right to establish
1) limitations of the amount of fiscal resources to be pledged
towards grants and purchases of services and 2) procedures for
purchases of services.
SECTION 2. Section 2-139. Hawaii County Code 1983, is amended
as follows:
"Section 2-139. Procedures for awarding grants.
(a) All grants made to a nonprofit organization by the county
shall be made in accordance with the follocainq procedure:
(1) Annually, before December 31, the director shall, for
the purpose of soliciting applications, establish a sum of at least
[$250,000] $900,000 to be available in the ensuing fiscal year for
funding requests by nonprofit organizations. In any event, the
maximum amount to be made available for grants shall not exceed one
percent of real property tax income. The director shall publish a
notice soliciting applications in a newspaper of general circulation
within the County of Hawaii by December 31.
(2) All applications for grants shall be submitted on or
before February 28, preceding the County's fiscal year, which begins
on July 1. Applications shall be prepared on forms provided by the
director. Applications not in conformance with the requirements of
the County Code may be rejected.
(3) The director shall submit to the council all
qualifying applications for its review and appropriation of funds.
(4) Upon favorable action by the council to appropriate
funds for the grant, the director shall prepare a contract with the
nonprofit organization for the purpose of the grant award which
shall meet all legal requirements of the County and shall include
program, fiscal and audit reporting requirements sufficient to allow
the director to effectively monitor and evaluate the use of the
grant. Agencies shall be notified of their funding or lack thereof
by July 31."

SECTION 3. Section 2-140, Hawaii County Code 1983, is amended as
follows:
"Section 2-140. Procedures for awarding purchase of services
agreements.
[(a) Agencies may purchase services from nonprofit organizations
by including such funding in the annual budget request or a
supplemental budget request.
(b) Upon council action appropriating the funds, the head of
the expending agency shall prepare a purchase of service agreement
with the nonprofit organization for the purchase of the required
services in accordance with all county legal requirements and to
include program, fiscal, and audit requirements sufficient to allow
the head of the expending agency to effectively monitor and evaluate
the delivery of services purchases.]
All purchase of services made to a nonprofit organization by
this county shall be made in accordance with the following procedure:
(1) Annually, before December 31, the director shall, for

applications in a newspaper of general circulation within the County
of Hawaii by December 31.
(2) All applications for purchase of services shall be
submitted on or before February 28 preceding the County's fiscal
year, which begins on July 1. Applications shall be prepared on
forms provided by the director. Applications not in conformance
with the requirements of the County Code may be rejected.

(3) The director shall submit to the Council all

funds for the purchase of service, the director shall prepare a
contract with the nonprofit organization for the purpose of the
urchase of service award which shall meet all legal requirements of
the County and shall include program, fiscal, and audit reporting
requirements sufficient to allow the director to effectively monitor
and evaluate the use of the purchase of service. Agencies shall be
notified of their funding or lack thereof by July 31."
SECTION 4. Material to be deleted is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material, and underscoring need not be included.
SECTION 5. If any provision of this ordinance or 'the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid
provision or application, and to this end, the provisions of this
ordinance are declared to be severable.
SECTION 6
This ordinance shall take effect upon its approval.
