ORDINANCE NO. s3 6`~
AN ORDINANCE AMENDING SECTION 18-3 OF THE HAWAII COUNTY CODE
PROVISIONS FOR THE APPOINTMENT OF MEMBERS TO THE COUNTY
TRANSPORATION COMMISSION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 18-3, of the Hawai County Code, is
amended to read as follows:
"There shall be a county transporation commission composed
of nine commissioners[,l• One commissioner shall be appointed
from each of the nine respective nine county council
districts. [one for each council district and three
at-large.] Commissioners shall be appointed by the mayor with
the approval of the council. Commissioners shall serve
staggered terms of five years, one member to be appointed to a
term of one year, two for a term of two years, two for a term
of three years, two for a term of four years, and two for a
term of five years. No member shall be eligible for a second
appointment to the commission prior to the expiration of two
years, provided that members of the commission initially
appointed for a term of one year and two years shall be
eligible to succeed themselves for an additional term. In the
transitional period following the amendment of this section of
the code, vacancies on the transvortation commission shall be
filled in ascending council district order as such order may
exist at the time an anoointment is made by the mavor."
SECTION 2. Materials to be repealed is bracketed. New
material is underscored. In printing this ordinance, neither
the bracketed material nor the underscoring need be included.
SECTION 3. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 4. This ordinance shall take effect upon approval.
