HomeMy WebLinkAboutORD 1993-084 1992-1994COUNTY OF HAWAII , :STATE OF HAWAII BILL NO. a 22 ORDINANCE NO. °3 84 AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983, RELATING TO PARKING VIOLATIONS CLERK. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 24, Section 24-202.2 of the Hawaii County Code 1983, is hereby amended to read as follows: "Section 24.202.2. Enforcement of article by [deputized) designated employees of the County. In addition to police officers authorized under section 24-12 and section 24-15 to enforce the provisions of this chapter, the regulations provided by this article shall be enforced by [duly deputized] employees of the County[.] who have been authorized under section 24- (citation power of Public Works employee)." SECTION 2. Chapter 24, Section 24-226 of the Hawaii County Code 1983, is hereby amended to read as follows: 'Section 24-226. Permit violations; enforcement. (a) It shall be unlawful for any person who has been granted a permit under this subdivision to violate any of the terms or conditions of the permit. (b) In addition to police officers authorized under section 24-12 to enforce the provisions of this chapter, this subdivision shall also be enforced by [duly deputized] employees of the County[.l who have been authorized under section 24- (citation power of Public Works employee)." SECTION 3. Chapter 24, Section 24-234 of the Hawaii County Code 1983, is hereby amended to read as follows: "Section 24-234. Enforcement of division. This division shall be enforced by [duly deputized) County employees who have been authorized under section 24- (citation power of Public Works employee) as well as by police officers of the County." SECTION 4. Chapter 24, Section 24-236 of the Hawaii County Code 1983, is hereby amended to read as follows: "Section 24-236. Parking in prohibited areas; towing vehicles, permit required. (a) Parking shall be permitted only in areas marked and specified for parking. Automobiles parked in prohibited areas shall be towed away at the expense of the owner. The [deputized] County employees who have been authorized under section 24- (citation power of Public Works employee) and police officers shall be authorized to enforce this section. (b) No person without a proper parking permit shall park in either a reserved,. theater parking space, or multi-level parking structure and no permittee, without written consent of the department of public works, shall let or assign to any person his or her reserved parking permit or privilege in a theater, or multi-level parking structure parking space." -2- SECTION 5. A new section is hereby added to and to be made a part of article 8, chapter 24, Hawaii County Code 1983 to read as follows: "Section 24- Citation power of public works employee. The chief engineer shall appoint one or more employees to enforce the provisions of this article. The employee or employees so appointed shall have the limited police power to issue a complaint and summons against persons whom such employee or employees find to be in violation of the parking regulations established under this article. The form of citatio and summons shall be approved by the chief engineer and shall be in a form commensurate with the form of other summons as used in modern police methods described in section 803-6, Hawaii Revised Statutes, as amended. The summons shall be enforceable in the manner described in section 803-6, Hawaii Revised Statutes." SECTION 6. Material to be deleted is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTIOP7 7. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. -~- SECTION 8. This ordinance shall take effect upon its approval.
