AN ORDINANCE AMENDING CHAPTER 15, HAWAII COUNTY CODE 1983, BY ADDING A NEW ARTICLE RELATING TO FARMERS MARKET. WHEREAS, the "farmers market" has become an accepted and welcomed activity allowing local residents to share their homegrown and homemade products; and WHEREAS, the "farmers market" provides another means by which unwanted and/or excess products and wares may be recycled within the community; and WHEREAS, the "farmers market" is also an excellent opportunity for families and individuals to subsidize their household income; and WHEREAS, the Council of the County of Hawaii finds that certain public facilities may be well-suited for farmers market activities; and WHEREAS, the Council further finds that engaging a nonprofit organization with a purchase of service contract for the administration and management of the farmers market program would minimize any imposition on existing county personnel and/or equipment. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 15, Hawaii County Code 1983, is amended by adding a new article to be appropriately designated and to read as follows: "Article Farmers Markets. Section 15 Intent. It is the intent of this ordinance to allow for the establishment of farmers markets at various county parks and facilities. Farmers markets will offer the general public the opportunity to buy and sell homegrown and homemade products and wares. Section 15 Director to Establish Time Limits. The director may establish reasonable limitations on the duration and frequency of any farmers market activities that may be allowed. Section 15 Site Map. The department may apportion and/or delineate the area within the county park as facility where the farmers market activity is allowed. The department shall provide a map of the farmers market site clearly delineating all farmers market spaces reserved for the exclusive use of any person granted a permit. Section 15 Designated Areas. The following are authorized designated areas: (a) Waimea. (b) Kona. (c) Honokaa County Park Complex. Section 15 Permit; Fee. All responsible persons, eighteen years of age or older, shall be allowed to secure a permit on their own to sell their products and wares grown, produced or made on the island of Hawaii in any of the designated farmers market sites subject to policies, rules and regulations established by the director. Permits shall be issued on a first-come, first-served basis and shall be based upon a fee of $5.00 per day. Each permit shall identify the permittee, the specific market space and site and the date(s) of said permit. No permit shall be issued for more than five consecutive days, nor shall any person be granted a permit for more than fifteen days in any given calendar month. The holder of a farmers market permit shall, upon request, show the permit to any law enforcement officer, park caretaker, or any personnel of the department or any administrator or manager contracted by the department therefor. Permit fees may be used by the department to enter into a purchase of services contract with a nonprofit organization for the administration and management of a farmers market program and/or site." SECTION 2. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 3. This ordinance shall take effect upon its approval.
