AN ORDINANCE AMENDING SECTION 25-86 (NOk1'H AND SOUTH KONA
DISTRICTS ZONE MAP), ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE
HAWAII COUNTY CODE, BY CHANGING THE DISTRICT CLASSIFICATION
FROM RESORT-HOTEL (V-2.25 AND V-10), MULTIPLE FAMILY
RESIDENTIAL (RM-3 AND RM-10), VILLAGE COMMERCIAL (CV-10) AND
OPEN (0) TO RESORT-HOTEL (V-2.25), MULTIPLE FAMILY RESIDENTIAL
(RM-3 AND RM-10), VILLAGE COMMERCIAL (CV-10) AND OPEN (O) AT
KAUPULEHU, NORTH KONA, HAWAII, COVERED BY TAX MAP

BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-86, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of properties described hereinafter as
follows:

SECTION 2. These changes in district classification are
conditioned upon the following:
(A) The applicant, successors or assigns shall be
responsible for complying orith all of the stated
conditions outlined in the previously approved Change

of Zone Ordinance No. 88-157, as amended by Ordinance
No. 92-95, and Special Management Area Use Permit
Nos. 271 and 272.
(B) Comply with all applicable laws, rules and
regulations and requirements; and
(C) Should any of the conditions contained herein not be
met or substantially complied with in a timely
fashion, the Director shall initiate rezoning of the
area to its original or more appropriate designation.
SECTION 3. In the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval.
