ORDINANCE NO. 95 14
AN ORDINANCE AMENDING CHAPTER 19 OF THE HAWAII COUNTY CODE 1983,
AS AMENDED, BY ADDING A NEW SECTION EXEMPTING NEW CONSTRUCTION IN
AN ENTERPRISE ZONE FROM REAL PROPERTY TAXES FOR THREE YEARS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The State of Hawaii, through
chapter 209E, Hawaii Revised Statutes, and chapter 6 of title 15,
Hawaii Administrative Rules, has established business enterprise
zones. In creating enterprise zones, the county may provide
local incentives to help promote business and economic
development. The county is willing to provide a three-year
exemption from real property taxes for all new construction by
qualified businesses within the enterprise zones established by
the county.
SECTION 2. Chapter 19, article 10, of the Hawaii County
Code 1983, is amended by adding the following item to be
appropriately numbered and to read as follows:
Section ( 1. Exemptions for Enterprise Zones.
SECTION 3. New material is underscored. In printing this
ordinance, the underscoring need not be included.
SECTION 4. Severability. If any provision of this
ordinance, or the application thereof to any person or
circumstance, is held invalid, the invalidity does not affect
other provisions or applications of the ordinance which can be
given effect without the invalid provision or application, and to
this end the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon its
approval.
