ORDINANCE NO. 3'S 21
A BILL FOR AN ORDINANCE RELATING TO THE REPORTING OF GIFTS BY COUNCIL
MEMBERS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this Ordinance is to establish a requirement relating to
disclosure by council members of gifts received.
SECTION 2. Chapter 2, Article 15, of the Hawaii County Code, as amended, is hereby
amended by adding new sections to be appropriately designated to read as follows:
"Section 2- .Reporting of Gifts by Council Members. Every council member shall
file a gm's disclosure statement with the county clerk on June 30 of each year if all the following
conditions are met:
(al The council member received directly or indirectlkfrom one source any gifr or gifts
whether the eift is in the form of money services goods or any other form'
(bl The source ofthe ig'ft or gifts has interests that may be affected by official action or
lack of action by the council member: and
(~l The gift is not exempted by Section 2- from reporting requirements under this
article.
Section 2- .Gifts Disclosure Statement. The gifts disclosure statement shall contain
the following information:
(al A description of the gift:
(bl The date the eift was received: and
(cl The name of the Berson business entity or orcani ation from whom or on behalf of
whom theg~ was received.
Section 2 Gifts Excluded from Re~rting~q~~irements. Excluded from the
renortinc requirements of this section are the followine:
(al Gifts received by will or intestate succession:
~oj Gifts received by way of distribution of any inter vivos or testamentary trust
Pstablished by a snouse or ancestor:
~ Gifts from a spouse fiance fiancee anxrelative within four decrees of consanguinity
or ththe se fiance or fiancee of such relative A gift from anv such person is a reportable eift
if the person is acting as an avent or intermediary for anv person not covered by this pazaeraph:
(dl Political campaicn contributions that comply with the state law:
(e Anything available to or distributed to the public generally without reeard to the
official status of the recipient:

claimed as a charitable contribution for tax purposes• and

SECTION 3. New ordinance material is underscored. In printing this ordinance, the
underscoring need not be included.
SECTION 4. In the event that any portion of the ordinance is declared invalid, such
invalidity shall not affect the other parts of this ordinance.
SECTION 5. This ordinance shall take effect upon its approval.
