ORDINANCE NO. 95 24
AN ORDINANCE AMENDING CHAPTER 22, ARTICLE 1, DIVISION 5, SECTION 25(b)
and (c), OF THE HAWAII COUNTY CODE 1983, AS AMENDED RELATING TO THE
USE OF SIDEWALKS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 22, Article 1, Division 5, Section 25(b) and (c), of the Hawaii
County Code 1983, as amended, is amended to read as follows:
"(b) Upon the finding that the use will not unreasonably endanger the public use of the
sidewalk or unreasonably impede pedestrian traffic, the Council shall grant a permit to the
applicant for a specified period, not to exceed [seven days] one year, to use a specified sidewalk
area for the purposes applied for [except that cafe table service may be granted for a period
longer than seven days not to exceed one year].
(c) The permit shall contain a provision that such properties or services will cover only
that portion of a sidewalk which allows for [at least six feet ofJ unobstructed and unimpeded
pedestrian traffic and will not exceed a height of four feet. All properties and services placed on
sidewalks shall be removed from the sidewalk at the close of business hours."
SECTION 2. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, the invalidity does not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 3. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material, and the underscoring need not be
included.
SECTION 4. This ordinance shall take effect upon its approval.
