HomeMy WebLinkAboutORD 1995-025 1994-1996COUNTY OF HAWAII STATE OF HAWAII BILL NO. i i (DRAFT 2) ORDINANCE NO. 95 25 AN ORDINANCE TO AMEND THE HAWAII COUNTY CODE RELATING TO THE TRAFFIC CODE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 24-3 (a) (1) of the Hawaii County Code (as amended), is hereby amended to read as follows: "(1) ["Ally"] "Alley„ means a street or highway intended to provide access to the rear or side of lots or buildings and not intended for the purpose of through vehiculaz traffic." SECTION 2. Section 24-3 (a) (13) of the Hawaii County Code (as amended), is hereby amended to read as follows: "(13) "Highway" means the width between the boundary lines of every way ~ ct to this Chapter [publicly maintained] when any part thereof is open to the use of the public for vehiculaz travel." SECTION 3. Section 24-3 (a) (48) of the Hawaii County Code (as amended), is hereby amended to read as follows: "(48) "Street" means the entire width between boundary lines of every way submit to this hat [publicly maintained] when any part thereof is open to the use of the public for purposes of vehicular travel." SECTION 4. Section 24-149 of the Hawaii County Code (as amended), is hereby amended to read as follows: "Section 24-149. Maximum speed limit. (a) The following maximum speed limit shall be in effect except where a special speed limit has been enacted: (1) Twenty-five Miles per Hour. (A) When passing a school site or the grounds thereof, which aze contiguous to or located in close proximity to, the highway and posted with the standard "school" warning sign while children aze going to be leaving the school during opening or closing hours. This speed limit shall also apply during school recesses when passing any school grounds which are not sepazated form the highway by a fence or other physical barrier capable of restraining a child, while the grounds within seventy-five feet of the highway aze in use by a child, and the highway is posted with the standazd "school" warning sign. (B) During school days for a distance of up to one thousand feet on both sides of a crosswalk designated by the Chief Engineer as a School Crossing and posted with the standard "School Crossing." (C) In a residential district, except for the streets in South Hilo as described in schedules 6 and 9, sections 24-258 and 24-261. f,~) On all streets withing the subdivision known as Hawaiian Ocean View Estates. Ka u. [(D)] ~ On all highways and streets unless otherwise specified by this chapter. (2) Thirty Miles per Hour. In a business district." SECTION 5. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material and underscoring need not be included. SECTION 6. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance aze declazed to be severable. SECTION 7. This ordinance shall take effect upon its approval.
