AN ORDINANCE AMENDING SECTION 25-95G (PUAKO-ANAEHUOMALU ZONE
MAP), ARTICLE 3, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY
CODE, BY CHANGING THE DISTRICT CLASSIFICATION FROM OPEN (O),
MULTIPLE FAMILY RESIDENTIAL (RM-3) AND (RM-4) AND
RESORT-HOTEL (V-1.25) TO OPEN (0), MULTIPLE FAMILY
RESIDENTIAL (RM-3) AND (RM-4) AND RESORT-HOTEL (V-1.25) AT
WAIKOLOA, KALAHUIPUAA AND ANAEHOOMALU, SOUTH KOHALA, HAWAII,
COVERED BY TAX MAP KEY 6-8-O1:PORTION OF 59 AND 6-8-22:PORTIOPIS

BE IT ORDAINED HY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-95G, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification oc' properties described Hereinafter as

SECTION 2. These changes in district classification are
conditioned upon the following:
A. The applicant, its successors, or assigns shall be
responsible for complying with all of the stated
conditions of approval.
B. Final Subdivision Approval for the consolidation and
resubdivision of the properties to conform with the
approved zone district boundaries shall be secured
within three years from the effective date of the
change of zone.
C. Archaeological mitigation shall be conducted as
follows:
1. An archaeological inspection shall be conducted
for the North Course Area (NCA), which
recommendations shall be approved by the Planning
Department, in consultation with the Department

of Land and Natural Resources-Historic Sites
Division prior to submitting plans for
subdivision review of the NCA parcels. If
further survey work and mitigation are required,
detailed mitigation plans shall be approved by
the Planning Department, in consultation with the
Department of Land and Natural Resources, prior
to Final Subdivision approval or any land
alterations of the project site.
2. A preservation plan and burial treatment plan for
the South Course Area (Hotel Site 3) shall be
prepared and submitted for approval by the
Planning Director, in consultation with the
Department of Land and Natural Resources-Historic
Preservation Division,. prior to submittal of
plans for subdivision review or any land
alteration activities within the project site.
The applicant shall obtain written verification
from the Department of Land and Natural
Resources-Historic Sites Division that applicable
portions of the approved plan have been properly
executed prior to the issuance of Final
Subdivision Approval or commencing any land
alteration activities within the project site.

An emergency road reserve connecting to the southern
property shall be set aside. The location of this
road and its improvements shall be coordinated with
the owner(s) to the south.
A minimum 100-foot setback from the certified
shoreline shall be maintained for the main structure
of Hotel #3. Structures and activities proposed
within the minimum 40-foot shoreline setback area
shall comply with Rule 8 of the Planning Commission.
The applicant shall comply with all applicable change
of zone ordinances and Special Management Area Use
Permits which affect the subject properties.
Should the Council adopt a Unified Impact Fees
Ordinance setting forth criteria for the imposition
of exactions or the assessment of impact fees,
conditions included herein shall be credited towards
the requirements of the Unified Zmpact Fees Ordinance.
An initial extension of time for the performance of
conditions within the ordinance may be granted by the
Planning Director upon the following circumstances:
1. The non-performance is the result of conditions
that could not have been foreseen or are beyond
the control of the applicant, successors or
assigns, and that are not the result of their
fault or negligence;

2. Granting of the time extension would not be
contrary to the General Plan or the Zoning Code;
3. Granting of the time extension would not be
contrary to the original reasons for the granting
of the change of zone; and
9. The time extension granted shall be for a period
not to exceed the period originally granted for
performance (i.e., a condition to be performed
within one year may be extended for up to one
additional year).
I. Should any of the conditions not be met or
substantially complied with in a timely fashion, the
Director may initiate rezoning of the area to its
original or more appropriate designation.
SECTION 3. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
