ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY
CODE, AS AMENDED, TO ALLOW CHURCHES AND SIMILAR INSTITUTIONS TO
APPLY FOR A USE PERMIT IN THE LIMITED INDUSTRIAL (ML) ZONED DISTRICT.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. PURPOSE. The purpose of this bill is to allow
churches, temples, and other institutions of a religious, cultural,
philanthropic, or charitable nature to apply for a use permit in the
Limited Industrial (ML) zoned district. These institutions have
changed over the years in their locational service to immediate
communities. A church's membership can now easily travel to the
church rather than the church having to locate close to its
membership. Through the use permit process, potential impacts to
the built environment and its infrastructure can be evaluated on a
case-by-case basis. It is felt that this method of land use review
would provide these special institutions with the economic and
locational flexibility needed to foster its spiritual and charitable
growth. ~ `~
SECTION 2. Section 25-28(a)(1), Article ~', Chapter 25 of the
Hawaii County Code is amended as follows:
"(a) A use permit shall be obtained from the planning
commission for the following uses within designated county-zoned
districts unless specifically permitted in a zoned district.
(1) All districts, except [ML,] MG and O districts:
churches, temples, and other institutions of a religious, cultural,
philanthropic, or charitable nature. A minimum lot area of 10,000
square feet is required within the RS, RD, RM, and RA districts."
SECTION 3. Material to be repealed is bracketed. New material
is underscored. In printing this ordinance, the brackets, bracketed
material, and underscoring need not be included.
SECTION 4. In the event that any portion of the ordinance is
declared invalid, such invalidity shall not affect the other parts
of this ordinance.
SECTION 5. This ordinance shall take effect upon its approval.
