COUNTY OF HAWAI~~;,~~TATE '' OF HAWAII BILL NO. 83 (DRAFT 3) ORDINANCE NO. 95 83 AN ORDINANCE AMENDING CHAPTER 19, OF THE HAWAII COUNTY CODE, 1983, RELATING TO PROPERTY TAX EXEMPTIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to allow property tax exemptions for persons with impaired sight or hearing and those totally disabled effective at the next tax payment date after they have been certified as having this disability. At present, a person who files for this exemption on December 31, of a given year could receive the benefit in the July tax bill of the ensuing yeaz, while someone filing on January 1, could not receive the benefit until July of the following year, which is 18 months later. SECTION 2. Chapter 19, Section 19-68, Subsection (a), of the Hawaii County Code, 1983, is amended to read as follows: "Section 19-68. Claims for certain exemptions. (a) None of the exemptions from taxation granted in sections 19-71, [19-73] 19-74. 19- 76 to 19-78 and 19-89.2 shall be allowed in any case, unless the claimant shall have filed with the department of finance, on or before December 31 preceding the tax yeaz for which such exemption is claimed, a claim for exemption in such form as shall be prescribed by the department. The exempSion from taxation granted for disabilities in section 19-73 and 19-75 chap be allowed from the next tax payment date: provided that the claimant shall have filed a claim for the disability exemption alone with a copv of the physician's certificate of disability with the department on or before June 30 for the first half payment or December 31 for the and half p~vment on such form as shall be prescribed by the department " SECTION 3. Materials to be repealed are bracketed. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect July 1, 1995.
