ORDINANCE NO. 95 86
AN ORDINANCE AMENDING CHAPTER 27 OF THE HAWAII COUNTY CODE 1983,
RELATING TO FLOOD CONTROL.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. In accord with the National Flood Insurance
Program, the Federal Emergency Management Agency (FEMA) has
issued an updated Flood Insurance Study (FIS) and three (3)
updated Flood Insurance Rate Map (FIRM) panels, effective date
June 2, 1995, to the County of Hawaii.
The 1990 FIS with the 1988 and 1990 FIRM panels together are
the basis for Chapter 27, as cited in Section 27-6. As the FIS
or any FIRM panels are updated by FEMA, the basis for Chapter 27
shall be updated and Section 27-6 shall be accordingly amended.
The purpose of this ordinance is to include the
June 2, 1995 updated FIS and FIRM panels within Section 27-6 as
the basis of Chapter 27.
SECTION 2. The June 2, 1995 updated FIS and FIRM panels
affect the North Kona district. Specifically, FEMA amends the
current FIRM Panels 0926D and 0927C to correct its omission of
1991 data for the vicinity of the Komohana Kai subdivision. This
omission occurred in FEMA's 1994 printing of FIRM Panel 0926D.
Upon notification of the omission, FEMA initiated corrective
procedures to include the 1991 data and to issue new FIRM Panels
0926E and 0927D which correctly include the 1991 data.
SECTION 3. Chapter 27 Section 27-6 is amended to read as
follows:
Section 27-6. Basis. The areas of special flood hazard
identified by the Federal Insurance Administration of the Federal
Emergency Management Agency in the Flood Insurance Study dated
July 16, 1990, and the Flood Insurance Rate Maps, dated July, 16,
1990 and September 16, 1988, attached hereto, are hereby adopted
and declared to be a part of this chapter. This Flood Insurance
Study and attendant mapping, with updates and revisions included
by ordinance amendments, are the minimum area of applicability of
this chapter. The Flood Insurance Study and Flood Insurance Rate
Maps, as amended, are on file at the Hawaii County Building,
Department of Public Works, 25 Aupuni Street, Room 202, Hilo,
Hawaii 96720.
(a) The May 16, 1994 updated Flood Insurance Study, FIRM
panels 0168E, 0713D, 0926D, and Map Index panel,
attached hereto, are hereby adopted and declared to be
a part of this chapter.
(1) The May 16, 1994 Flood Insurance Study shall
supplement the July 16, 1990 Flood Insurance
Study.
(2) The FIRM panels 0168 E, 0713D, and 0926D shall
replace the FIRM panels 0168D, 0713C, and 0926C,
respectively.
(3) The May 16, 1994 Map Index panel shall replace the
July 16, 1990 Map Zndex panel.

u The June 2, 1995 undated Flood Insurance Study, FIRM
Panels 0926E, 0927D, and Man Index panel, attached
hereto, are hereby adopted and declared to be a Hart of
this chanter.
u The June 2, 1995 Flood Insurance Studv shall
supplement the May 16, 1994 and Julv 16, 1990
Flood Insurance Studies.
,~_ The FIRM panels 0926E and 0927D shall replace the
FIRM panels 0926D and 0927C, respectively.
u The June 2, 1995 Map Index panel shall replace the
May 16, 1994 Map Index panel.
SECTION 4. Materials to be repealed are bracketed. New
materials are underscored. In printing this ordinance, the
brackets, bracketed materials, and underscoring need not be
included.
SECTION 5. This ordinance shall take effect upon its
approval.
