ORDINANCE NO. 95 112
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, OF THE HAWAII
COUNTY CODE 1983, AS AMENDED, RELATING TO VEHICLES AND TRAFFIC BY
DELETING THOSE SECTIONS THAT RELATE TO REGULATION OF TRAFFIC ON
STATE HIGHWAYS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. Chapter 291C of the Hawaii Revised
Statutes, as amended, which is known as the Statewide Traffic
Code, and Section 264-43 of the Hawaii Revised Statutes, as
amended, authorize the State Director of Transportation to
regulate and control traffic on state highways. Section 24-9 (b)
of the Hawaii County Code requires the State of Hawaii's district
engineer to exercise certain functions. The county code does not
have power over a state government employee, and the control of
state highway traffic is under the jurisdiction of the State of
Hawaii Director of Transportation. Therefore, the purpose of
this bill is to delete from the county code those parts which
pertain to traffic control on state highways.
SECTION 2. Chapter 24, article 2, section 24-9, of the
Hawaii County Code is amended by deleting the following items:
"Section 24-9. Maintenance of signals by chief engineer
(and district engineer]."
[(b) Subject to section 24-8, the district engineer
shall, on State maintained highways, place and maintain official
traffic control devices, signs, signals and markings consistent
with standards approved by the Federal Highway Administration,
U.S. Department of Transportation.]
SECTION 3. Chapter 24, article 10, division 1, section 24-
255, schedule 3, of the Hawaii County Code, relating to 25 miles
per hour speed limit, is amended by deleting the following items:
[(7) Honokohau Small Boat Harbor Road, beginning at
the Kailua-Kawaihae Road, for a distance of approximately one
mile.]
[(26) Mamane Street, from Plumeria Road intersection
to Ohia Street.]
[(44) On Route 11 (Mamalahoa Highway), beginning at a
point 0.2 miles Kona of mile marker 63 and ending 0.2 miles on
the Kona side of the 64 mile marker.]
SECTION 4. Chapter 24, article 10, division 1, section
24-257, schedule 5, of the Hawaii County Code, relating to 35
miles per hour speed limit, is amended by deleting the following
items:
[(4) Hawaii Belt Road, from Kanoa Street to a point
two hundred feet Puna of the Waianuenue Street intersection.
(5) Hawaii Belt Road, from a point four thousand
feet west of the access road to Waipunalei Camp to a point two
thousand five hundred feet east of the Ookala Village access
road.
(6) Hawaii Belt Road, from the north access road
leading to Hookena Beach southward to the beginning of Project
No. BF-011-1(3) at Papa for the duration of construction of the
Project.]

[(8) Hilo Bayfront Highway, from a point eight
hundred feet east of the Pauahi Street intersection to Kamehameha
Avenue.
(9) Honokaa-Waipio Road through Camp 10.
(10) Honokaa-Waipio Road, from the westerly side of
the Kaauhuhu Homestead to the easterly side of the Kapulena
Subdivision Unit 1.
(11) Honokaa-Waipio Road, from a point six hundred
feet west of Camp 106 the Waipunahoe Stream Bridge.]
(12) Honokaa-Waipio Road, from Nienie Bridge to
Plumeria Road intersection.]
[(19) Kanoelehua Street, from Kamehameha Avenue to a
point five hundred feet south of Pookela Street.
(20) Kawaihae Road, from the easterly side of the
Kawaihae Stream Bridge to a point four hundred feet westerly of
the intersection with the Kawaihae-Mahukona Road.
(21) Kawaihae-Mahukona Road, from the intersection
with Kawaihae Road to a point one thousand feet south of Honokoa
Bridge.]
[23) Keaau to Pahoa Road, from its intersection with
the Hawaii Belt Road to a point 0.3 miles toward Pahoa ]
[(29) Mahukona to Niulii Road, from a point two
thousand four hundred feet on the Mahukona side to a point six
hundred fifty feet on the Hawi side of the beginning of Project S
203(3) in Kokoiki, Kohala.
(30) Mahukona to Niulii Road, from the west end of
the Kahei House lots to a point one thousand three hundred
twenty-five feet on the Niulii side of the Hawi Junction Road at
Hawi, Kohala.
(31) Mahukona to Niulii Road, from a point three
hundred fifty feet on the Hawi side of the access road to Kohala
High and Elementary School to a point five hundred feet on the
Niulii side of Project S 203(2) at Kapaau, Kohala.
(32) Mahukona-Niulii-Pololu Road, from a point two
thousand one hundred sixty feet on the Hawi (west) side of the
entrance to the Halaula School to the Pololu Valley Lookout.]
[(35) Mamalahoa Highway (Route 11), from a point
approximately 1.1 mile east of the South Point Road, to a point
approximately 0.2 mile on the Naalehu side of the sixty-four mile
post.]

[(40) Pahoa-Kalapana Road, from Kaimu Junction for a
distance of one thousand feet in the mauka direction.]
SECTION 5. Chapter 24, article 10, division 1, section
24-258, schedule 6, of the Hawaii County Code, relating to 35
miles per hour maximum speed limit, is amended by deleting the
following items:
[(11) Puainako Street, from mauka terminal to Kinoole
Street.]
SECTION 6. Chapter 24, article 10, division 1, section
24-260, schedule 8, of the Hawaii County Code, relating to 45
miles per hour speed limit, is amended by deleting the following
items:
[(1) Hawaii Belt Road in Papaikou, from a point one
thousand feet south (toward Hilo) of Kapue Bridge to Kalaoa Mauka
Camp Road.
(2) Hawaii Belt Road in Ninole, from a point four
hundred twenty feet from the Hamakua end of Waikaumalo Bridge to
the Hilo end of SDR-3(15).
(3) Hawaii Belt Road from the Hilo side of Moanalua
Bridge to the twenty-five mile post in Laupahoehoe.
(4) Hawaii Belt Road, from a point seven hundred
feet west of the intersection of Plumeria Street with the Hawaii
Belt Road to a point one thousand two hundred feet east of the
intersection of Lehua Street with the Hawaii Belt Road.
(5) Hawaii Belt Road in Kona, from the end of FAP
8-G (Captain Cook) to the beginning of FAP 8-D (Honaunau).
(6) Hawaii Belt Road, from a point four hundred feet
on the Hilo side of the Hakalau Bridge to a point seven hundred
feet on the Hilo side of the Chin Chuck intersection.
(7) Hawaii Belt Road in Keaau, in the Hilo
direction, from the Keaau Mill Road to the Slaughter House Road.
(8) Hawaii Belt Road in Paauilo, from two hundred
feet Hilo of East Paauilo Bridge to a point 0.2 miles Honokaa of
the Paauilo Access Road.

(9) Hawaii Belt Road, from a point eight hundred
feet west to a point one thousand two hundred feet east of the
intersection of Lehua Street with the Hawaii Belt Road.
(10) Hawaii Belt Road in Keaau, from a point nine
hundred feet south of the Pahoa Road intersection to the
beginning of the inbound lane.
(11) Hawaii Belt Road in Ka'u, from a point 1.1 mile
east of the South Point Road, to a point 0.4 mile on the Kona
side of the seventy mile post.
(12) Honokaa-Waipio Road, from the Waipunahoe Stream
Bridge to Nienie Stream Bridge except through Kaauhuhu Homestead,
Kapulena, and Camp 10.
(13) Kawaihae Road, from the Waiaka Bridge to an
existing cattleguard four thousand three hundred twenty feet
makai on said road.
(14) Ke Ala O Keawe, City of Refuge Road, from the
Hawaii Belt Road at Keokea Junction to the junction with Puuhonua
Road.]
[(17) On Route 11 (Mamalahoa Highway and Hawaii Belt

(21) The Waimea to Hawi Road, from a point two
hundred feet Hawi of the access road to the Hawaii Preparatory
Academy to the beginning of Project FAP E 11A.]
SECTION 7. Chapter 24, article 10, division 1, section
24-263, schedule 11, of the Hawaii County Code, relating to 55
miles per hour speed limit, is amended by deleting the following
items:
[(1) The Kailua-Kawaihae Road, from a point seven
hundred fifty feet north of the access road to Honokohau Harbor
to a point one thousand fifty feet south of the access road to
Keahole Airport.

(2) The Kawaihae-Mahukona Road, from a point one
thousand feet south of Honokaa Bridge to a point two hundred
fifty feet south of the access road to Mahukona Harbor.
(3) Hawaii Belt Road, from Paauilo to a point seven
hundred feet east of the intersection of the Honokaa Access Road
(FASP 5-238(1)) with the Hawaii Belt Road.
(4) Hawaii Belt Road, from Papa to Kahuku.
(5) Hawaii Belt Road, from a point seven hundred
feet west of the intersection of Plumeria Lane with the Hawaii
Belt Road to Mud Lane.
(6) Hawaii Belt Road, from the southern boundary of
the Hawaii Volcanoes National Park to a point opposite the fifty
mile post.
(7) Hawaii Belt Road inbound into Hilo from Volcano;
from one hundred feet Hilo side of Slaughter House Road to seven
hundred feet Puna side of Makalika Street..
(8) Hawaii Belt Road outbound from Hilo to Volcano;
from five hundred feet Puna side of Makalika Street to one

SECTION 8. Chapter 24, article 10, division 2, section
24-266, schedule 14, of the Hawaii County Code, relating to
through streets, is amended by deleting the following items:
(a) Hamakua:

(c) South Hilo:
[(29) Kanoelehua Avenue, from Kamehameha Avenue
to its end in the southerly direction.]

the Waimea to Kawaihae Road intersection to the Niulii-Mahukona
Road in Hawi.

[(4) The Pahoa-Kalapana Road, from the
intersection with the Pahoa-Kapoho Road to the National Park
Entrance, except for the "stop" intersection authorized in
schedule 12, section 24-264(e)(9) and (10).]

SECTION 9. Chapter 24, article 10, division 2, section
24-267, schedule 15, of the Hawaii County Code, relating to one-
way streets, is amended by deleting the following items:
[(5) Hawaii Belt Road, between Keaau Village Access
Road on the north end of Keaau Village (Station 1080 + 35 FAP No.
F-O11-2(2)) to the intersection of Mamalahoa Highway and Makalika
Street in Hilo. All vehicular traffic shall move only from the
Hilo to Keaau direction on the mauka lanes and from the Keaau to
Hilo direction on the makai lanes.]
SECTION 10. Chapter 24, article 10, division 2, section
24-271, schedule 19, of the Hawaii County Code, relating to
prohibited left turn areas, is amended by deleting the following
items:
[(4) Kamehameha Avenue at Manono Street for Hamakua
bound traffic except on the green arrow or at the direction of a
police officer.]
[(10) Mamalahoa Highway in Paauilo where it merges
with the Hawaii Belt Road (Prof. DF-019-2(5)).]
SECTION 11. Chapter 24, article 10, division 2, section
24-273, schedule 21, of the Hawaii County Code 1983, relating to
permitted U-turn areas, is amended by deleting the following
item:

in Honokaa.]
[(6) Mauka-bound traffic only, on Palani Road at the
intersection of Palani Road and Queen Kaahumahu Highway, North
Kona.

(8) Intersection of Pohaku Street and Kanoelehua
Avenue, outbound direction (away from Hilo) only.
(9) Intersection of Makaala Street and Kanoelehua

(10) Intersection of Kahaopea Street and Kanoelehua
Avenue.]
SECTION 12. Chapter 24, article 10, division 2, section
24-274, schedule 22, of the Hawaii County Code, relating to
prohibited U-turn areas, is amended by deleting the following
items:

SECTION 18. Material to be repealed is bracketed. In
printing this ordinance, the brackets and bracketed material need
not be included.
SECTION 19. If any provision of this ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 20. This ordinance shall take effect upon its
