AN ORDINANCE AMENDING ORDINANCE NO. 95-75, AS AMENDED, RELATING TO
PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR JULY 1,
1995 TO JUNE 30, 1996.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The purpose of this ordinance is to 1)
reappropriate the lapsed fuel tax district appropriations of
Ordinance No. 92-74 back to their respective district and 2)
appropriate the lapsed fuel tax circle island appropriation and the
excess fuel tax collections over appropriations of Ordinance No.
92-74 to various districts in accordance with the district formula as
set forth in Resolution 128-93.
SECTION 2. Ordinance No. 95-75, as

Allotments from these district appropriations shall be made to the
specific projects listed on the attached Exhibit A.
The district amounts are derived from the tables contained in Exhibit
B, which is attached hereto for information only.
SECTION 3. Funds for these projects shall be provided from the
Unallotted Appropriations Fuel Tax Increase 92-94 Account (2236.01)
of the Capital Projects Fund.
SECTION 4. If any provision of this ordinance is held invalid,
such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision
or application, and to this end, the provisions of this ordinance are
declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
