STATE OF HAWAII BILL NO. i6s (DRAFT 4) ORDINANCE NO. 95 15~ AN ORDINANCE AMENDING CHAPTER 24 OF THE HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO TRAFFIC VIOLATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAIL SECTION 1. Purpose. The purpose of this Bill is to address and improve certain areas of the Hawaii County Code related to Pazking Meters and the County Building Pazking Lot. The Bill allows for payment of a flat rate for metered parking in lieu of placing coins in the appropriate parking meter. The Bill also changes the Code to move authorization of the metered stalls located at the County Building from the County Building Pazking Lot Section of the Code to the Parking Meter Zones Section of the Code. Lastly, the Bill cleans up some of the language in the Code which may have been unclear or confusing. SECTION 2. Chapter 24, Article 8, Division 4, Subdivision 1, Section 24-216, of the Hawaii County Code 1983, as amended, is hereby amended to read as follows: "Section 24-216 Deposit of Coins; Time Limits. (a) No person shall pazk a vehicle in any parking space [upon a street] alongside of which a parking meter has been installed during the [restricted and] regulated time applicable to the parking meter zone in which the meter is located unless a coin or coins of United States currency of the appropriate denomination shall have been deposited therein, or shall have been previously deposited therein for an unexpired interval of time, [and the meter has been placed in operation.] r he pe~son~ys to the county a flat rate pursuant to Section 216.01. (b) No person shall permit a vehicle within his control to be parked in any parking meter space during the [restricted and] regulated time applicable to the parking meter zone in which the meter is located while the pazking meter for such space indicates by signal that the lawful parking time in the space has expired[.] unl the person ~avs to the county a flat rate pursuant to Section 216.01. This subsection shall not apply to the act of pazking or the necessary time which is required to deposit immediately thereafter a coin or coins in the meter. (c) No person shall park a vehicle in any parking meter space for a consecutive period of time longer than that limited period of time for which parking is lawfully permitted in the parking meter zone in which the meter is located, irrespective of the number or value of coins deposited in the meter and reeardless of a whether a flat rate payment pursuant to Section 216 O1 is made (d) The provisions of this section shall not relieve any person from the duty to observe other and more restrictive provisions of this chapter prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times." SECTION 3. SECTION 4. Chapter 24, Article 8, Division 4, Subdivision 1, Section 24-217 of the Hawaii County Code 1983, as amended, is hereby amended to read as follows: "Section 24-217. Hours of operation; exceptions. (a) The provisions of section 24-216 and 24-216.01 shall be in effect between the hours of 8:00 a.m. and 4:00 p.m. on each day, except Sundays and public holidays. (b) Whenever seventy-five consecutive days have passed without a traffic fatality in this County, the chief of police may dispense with the enforcement of section 24- 216 and 24-216.01 for one full day, other than Saturday, such date to be designated by him and be given reasonable circulation throughout the County. (c) The council may, by resolution, dispense with the enforcement of section 24-216 and 24-216.01 for a specified parking meter zone, to accommodate any special event, convention, parade, or other similar activity." SECTION 5. Chapter 24, Article 8, Division 4, Subdivision 1, Section 24-220 of the Hawaii County Code 1983, as amended, is hereby amended to read as follows: "Section 24-220. Collection, deposit, and application of proceeds. (a) It shall be the duty of the chief engineer[to designate some member of his department]. or their designee b~private contract or internal assi ng ment. to make regular collections of the money deposited in the meters and it shall be the duty of the person so designated to remove from the parking meters coins deposited in the meters. Such person shall service the parking meters, count the coins from the parking meter, [count the] determine the value of the coins collected, and deposit the coins in a fund entitled "Parking Meter Fund" to be created and held by the department of finance. 2 (b) The director of finance shall direct some member of his department to make periodic checks of the pazking meters and collection procedure. (c) The coins required to be deposited in pazking meters and the moneysent in to the Count pursuant to Section 24-216.01. aze levied and assessed as fees to provide for the purchase, rental, acquisition, supervision, collection, use, protection, inspection, installation, operation, maintenance, control, and regulation of parking meters, ofoff-street pazking spaces, of the parking of vehicles, and of other facilities and properties incidental to the regulation and control of traffic and in promoting the safety and well being of the public in handling of traffic upon the streets. The chief engineer. or their designee by private contract or internal assiPnment. shall collect and process monies sent in to the Countpursuant to Section 24- 216.01." SECTION 6. Chapter 24, Article 10, Division 7, relating to Parking Meter Zones of the Hawaii County Code 1983, as amended, is hereby amended to read as follows: "Section 24-289. Schedule 37. 36 minute parking meter zones. Thirty-six minute parking meter zones aze established upon those streets or portions of streets described in this schedule, upon which the pazking of vehicles shall be regulated by pazking meters at the rate of one cent for every six minutes or a flat rate for up to 36 minutes pursuant to Section 24-216.01: (]) Kekaulike Street, from Waianuenue Avenue to Wailuku Drive. (2) The makai side of Kinoole Street, from Waianuenue Avenue to Wailuku Drive. Section 24-290. Schedule 38. One hour parking meter zones. One hour parking meter zones aze established upon those streets or portions of streets described in this schedule, upon which the parking of vehicles shall be regulated by pazking meters at the rate often cents per hour[.] or a flat rate for up to one hour pursuant to Section 24-216.01: (]) Keawe Street, from Haili Street to Mamo Street. Section 24-291. Schedule 39. 2 hour parking meter zones. Two hour parking meter zones are established upon those streets or portions of streets described in this schedule upon which the parking of vehicles shall be regulated by parking meters at the rate often cents per hour or a flat rate for un to two hours pursuant to Section 24-216.01: (1) The old County Building Pazking lot located at the northeast corner of the Waianuenue Avenue and Keawe Street intersection. (2) Haili Street between Kamehameha Avenue and Kinoole Street. (3) Kalakaua Street. (4) Kamehameha Avenue, from Shipman Street to Waianuenue Avenue. (5) Keawe Street, from Wailuku Drive to Haili Street. (6) Kekuanaoa Street, between Honu Lane and Kilauea Avenue. (7) Kilauea Avenue, from Haili Street to Kukuau Street. (8) Kinoole Street, mauka side, from Waianuenue Avenue to Wailuku Drive. (9) Kinoole Street, on the mauka side, between Hili Street and Mamo Street, five mazked stalls in front of Fazmers' Exchange. (10) Mamo Street. (11) Shipman Street. (12) Waianuenue Avenue, from Keawe Street to Kamehameha Avenue. (13) Kinoole Street, makai side from Kalakaua Street to a point two hundred seventy- nine feet southeast of Mamo Street; mauka side, from Waianuenue Avenue to Haili Street. (14) Furneaux Lane, from Kilauea Avenue to Kamehameha Avenue. (15) Kamehameha Avenue, from Waianuenue Avenue to Ponahawai Street. (16) Punahoa Street. (17) The County parking lot (Kamehameha Parking Lot) along the mauka side of Kamehameha Avenue, from Waianuenue Avenue to Ponahawai Street. (18) Ponahawai Street, Hamakua side, from Kamehameha Avenue to Kinoole Street; Puna side, from Kilauea Avenue to Kinoole Street. (19) Waianuenue Avenue, Hamakua side, between the entrance and exit driveways into the Hilo High School grounds and fronting the Administration Building. (20) Mohouli Street, between Kilauea Avenue and a point one hundred sixty feet mauka of Kilauea Avenue. (21) Kinoole Street, mauka side, the first six stalls south of Ponahawai Street and central fire station. (22) Kinoole Street, makai side, the first six stalls south of Ponahawai Street. (231 The County Building_parking lot at the corner of Aupuni Street and Pauahi Street. Section 24-292. Schedule 40. 8 hour parking meter zones. The following areas aze designated as maximum eight hour pazking at the rate of five cents per hour or a flat rate for un to eight hours pursuant to Section 24-216.01: (1) The County parking lot (Bayfront Pazking Lot) along the makai side of Kamehameha Avenue between Kalakaua Street and Mamo Street. (2) Hilo Armory pazking lots, mauka and makai. (3) Wailuku Drive, Kamehameha Avenue to Kinoole Street. (4) Nawahi Lane. (5) Haili Street, Puna side, from Kinoole Street, to Ululani Street. (6) Kinoole Street, mauka side, from Haili Street to Ponahawai Street, except those five metered stalls in front of Fazmer's Exchange. (7) Kinoole Street, makai side, from a point two hundred sixty-nine feet southeast of Mamo Street to Ponahawai Street. (8) Ponahawai Street, Puna side, from Kamehameha Avenue to Kilauea Avenue." SECTION 7. Chapter 24, Article 8, Division 5, Section 24-230 of the Hawaii County Code 1983, as amended, is hereby amended to read as follows: "Section 24-230. Director of finance to set rates; [theater parking;] rental computation. (a) [The rates for metered stalls shall be set by the director of finance.] Rental in [theater parking,] reserved parking [and the multi-level parking structure] shall be 4 established by the director of finance. The director of finance may change the rates effective as of a date to be designated in a written notice thereof, which date shall be not less than thirty days after the giving of such notice. (b) The rental for reserved [, theater parking and multi-level] pazking shall be on a month-to-month term, the applicable rent to be in advance without notice or demand. County employees shall utilize payroll deduction for the payment of the pazking stalls. (c) Rentals shall be computed on asemi-monthly and monthly basis applicable to permanent and temporary pazking privileges. [(d) Rates for metered stalls shall be 5 cents for each fifteen minutes of parking time. (e) No person shall park a vehicle in any parking meter space for a consecutive period of time longer than two hours, irrespective of the number or value of the coins deposited in such meter. SECTION 8. New material is underscored. Material to be repealed is bracketed. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 9. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance aze declazed to be severable. SECTION 10. This ordinance shall take effect on July I, 1996.
