BILL NO. 72 09 74 AN ORDINANCE AMENDING CHAPTER 18, ARTICLES 1 AND 2, OF THE HAWAI'I COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO COMMON CARRIERS, TAXICABS AND SCHOOL BUSES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HA W AI' I: SECTION 1. Purpose. Clarify the taxicab permit and its issuing authority. SECTION 2. Section 18-1, Hawai'i County Code 1983 (2005 edition, as amended), is amended by adding the definition of "director of finance" as follows: "Director of finance" means the director of finance or a person designated by the director of finance. SECTION 3. Section 18-38, Hawai'i County Code 1983 (2005 edition, as amended), is amended to read as follows: Section 18-38. Permit required; content. No person shall drive a taxicab without first obtaining a taxicab driver's permit from the director of finance. The permit shall be mounted in a prominent place within the taxicab being driven by the person to whom it was issued. The permit shall be mounted so that it is visible to all passengers. The permit shall bear a [serial] permit number, the name ofthe person, [the person's address] name of the taxicab company, and a recent color photograph of the person, two copies of which shall be furnished by the applicant, the photograph to be no less than three inches in height and two inches in width. It shall be a violation of this section for any person to alter such taxicab driver's certificate. SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6.
