SUBJECT: Bill to Amend Chapter 5, Article 1, Section 5-1.0.8 and Chapter 21, Section 21-5 of the
Hawaii County Code 1983 (2005 Edition, as amended) Relating to the Use of a Tent or
Structure of Similar Type as a Temporary Residence While Constructing a Permanent
Dwelling Unit
For the Council's consideration, please find attached a bill to amend the Hawaii County Code to allow
those holding active building permits the opportunity to live in a temporary structure on their building
site while they construct their permanent home.
The amendments to the County Code would allow a landowner to live in the temporary structure for
two years from the date of issuance of the building permit, providing certain conditions are sustained.
Those conditions include adequate sanitation, emergency access, fire safety, electrical safety, a buffer
zone between building and living areas, and protecting the county for any injury or property damage
that may occur as the result of the temporary living arrangements. These conditions are further detailed
within the proposed amendments.
