RESOLUTION N0.
RESOLUTION AUTHORIZING A GRANT OF EASEMENT TO HAWAII ELECTRIC
LIGHT COMPANY, INC.
WHEREAS, the County is the owner of certain premises,
located at Waiakahiula and at Kaniahiku Homesteads, Puna, County
and State of Hawaii; and
WHEREAS, Hawaii Electric Light Company, Inc. are desirous of
obtaining easement rights over said County-owned lands for the
purpose of installing anchors, guy wires and associated
facilities and equipment as may be necessary for the
transmission and distribution of electricity for light and
power, said easement area being delineated in Exhibit "A" and
"B", attached hereto and made a part hereof; and
WHEREAS, §2-111 of the Hawaii County Code requires that any
grant of interest in real property owned by the County must be
authorized by resolution of the County Council.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Honorable Stephen K. Yamashiro, Mayor of the
County of Hawaii, is hereby authorized to execute a grant of
easement in favor of Hawaii Electric Light Company, Inc., for
the purpose of allowing those public utility companies to
install and maintain anchors, guy wires and associated
facilities and equipment, over the hereinabove described
County-owned property.
BE IT FURTHER RESOLVED, that the Clerk of the County of
Hawaii transmit copies of this resolution to the Honorable
Stephen K. Yamashiro, Mayor of the County of Hawaii, and George
Yoshida, Director of the Department of Parks and Recreation.
