RESOLUTION AUTHORIZING THE ACCEPTANCE OF REAL PROPERTY FOR ROAD
AND DRAINAGE PURPOSES FROM JAMES K. SCHULER & ASSOCIATES INC.
WHEREAS, James K. Schuler & Associates, Inc., hereinafter
referred to as "Schuler," is the owner of those certain road
and drainage parcels located in Waikoloa, South Kohala, Hawaii,
such parcels being more particularly described in Exhibit "A,"
and delineated in Exhibit "B," both of which are attached
hereto; and
WHEREAS, Schuler is desirous of dedicating the subject
parcels to the County of Hawaii for road and drainage purposes;
and
WHEREAS, the subject road and drainage improvements have
been completed according to County of Hawaii standards and is
in acceptable condition for dedication; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County
Charter provides, inter alia, that the Council, on behalf of
the County, may accept gifts of real estate or any interest in
real estate.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL of the
County of Hawaii that in accordance with Article XIII,
Section 13-12 of the Hawaii County Charter, the County of
Hawaii hereby accepts from James K. Schuler & Associates, Inc.,
the dedication of the subject real property for road and
drainage purposes.
