(DRAFT 2) RESOLUTION DIRECTING THE CORPORATION COUNSEL TO RECOVER DAMAGES AS A RESULT OF THE MALICIOUS BURNING OF THE TEAHOUSE AT LILIUOKALANI PARK WHEREAS, the teahouse situated in Hilo's Queen Liliuokalani Gardens was a gift to the Big Island in July of 1972 by the 400-year-old Urasenke Foundation of Kyoto, Japan, to provide a cultural oasis for the dissemination of the art and practice of tea; and WHEREAS, the principles of the tea ceremony emphasize harmony among people and between people and nature, and peace of mind; and WHEREAS, from the tea ceremony, many other aspects of the Japanese culture have evolved, such as flower arranging, calligraphy, garden design and etiquette; and WHEREAS, on or about May 14, 1994, it appears that responsible parties, acting without justification or excuse, maliciously set fire to the teahouse at Liliuokalani Park which facility and park are owned and operated by the County of Hawaii; WHEREAS, the loss of the County of Hawaii and its taxpayers is believed to aggregate at least $100,000; NOW THEREFORE, be it resolved that the Corporation Counsel of the County of Hawaii is hereby directed and instructed to initiate a civil action against the perpetrators of this wrongful act and all others potentially responsible seeking to recoup and recover the County's monetary damages. BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit a copy of this resolution to the Mayor of the County of Hawaii and the Corporation Counsel of the County of Hawaii.
