STATE OF HAWAII RESOLUTION N0. 29 95 (]?raft 2) A Resolution Relating To Council-Initiated Amendments to the Zoning Code WHEREAS, Section 25-21 of the Hawaii County Code provides for Council-initiated amendments to the zoning code be prepared by the Planning Director and reviewed by the Planning Commission; and WHEREAS, the Director shall study the proposed amendment and shall submit a recommendation to the Planning Commission who shall then recommend within a reasonable time, the approval or disapproval of any proposed amendment after the conclusion of at least one public hearing and shall file a report of its findings and action for council consideration; and WHEREAS, Council-initiated amendments to the zoning code have been referred to the Director and the Planning Commission for the proper review process as provided in Section 25-21; and WHEREAS, the Council finds that from time to time, Council bills proposing amendments to the zoning code have had unwarranted delays at both the Planning Director level and at the Planning Commission level without any recommendation to the Council; and WHEREAS, the Council finds that the length of time for the Council to receive recommendations for such bills goes beyond a normal or acceptable time, and well beyond the scope of time intended in this section of the zoning code for the conduct of Council's legislative affairs; and WHEREAS, the Council feels that a time table reflecting the Council's legislative intent should be established for the review of Council-initiated bills relating to the zoning code. THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that Council-initiated amendments to the zoning code be studied, heard, and transmitted back to the Council with recommendations within one-hundred-twenty (120) days from the date of Council's transmittal to the Planning Director. BE IT FURTHER RESOLVED that when the specified deadlines for any Council- initiated zoning code amendment aze not met, such proposed amendments by a majority vote by the Council thereafter, may be re-referred to the Council's Committee on Planning for its deliberation and action without further delay due to the lack of the Planning Commission action. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to Stephen Yamashiro, Mayor of Hawaii County; Virginia Goldstein, Planning Director; and Wilton K.
