RESOLUTION ACCEPTING KUA'AINA ROAD, ALSO KNOWN AS MIDDLE ROAD,
KEAAU, PUMA, AS A COUNTY ROAD.
WHEREAS, Kua'aina Road, which is also known as Middle Road,
connects the Hawaii Belt Road with Iwasaki Village Subdivision
in Puna; and
WHEREAS, this road provides the only feasible access for the
inhabitants of the village and surrounding lots; and
WHEREAS, no person has exercised any act of ownership over
this road for more than five years; and
WHEREAS, the road has fallen into a state of disrepair; and
WHEREAS, the circumstances with this particular road are
unusual and compelling; and
WHEREAS, Hawaii Revised Statutes, Section 264-1, provides
that where no act of ownership has been exercised over a road,
way, or lane for more than five years and, in the case of a
County highway, where the legislative body has accepted the same
by resolution, the road, way, or lane shall become a County
highway.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the County
of Hawaii, that Kua'aina Road, also known as Middle Road, Keaau,
Puna, between the Hawaii Belt Road (Volcano Highway) and the
Iwasaki Village Subdivision is hereby accepted as a County
Highway; and
BE IT FURTHER RESOLVED, that the County maintain this
roadway and fund annual maintenance which may involve the
hauling/spreading and grading of at least 20 truck loads of
cinder or crushed rock or stabilizing with pavement when such
funding becomes available; and
BE IT FINALLY RESOLVED that the Clerk file a certified copy
of this resolution with the State Bureau of Conveyances and
provide further copies to the Mayor, the Chief Engineer, and the
Director of Finance.
