WHEREAS, the Hawaiian Homes Act (the "Act") was originally passed by the
Congress of the United States in 1920 and 1921; and
WHEREAS, some 103,490 acres of land in Hawaii County aze now designated as
"available" lands under the terms of of the Act; and
WHEREAS, the Department of Hawaiian Home Lands is authorized to enter into
lease agreements with beneficiazies of the Hawaiian Home Lands Trust; and
WHEREAS, the Department of Hawaiian Home Lands has awazded as authorized
by the Hawaiian Homes Act of 1920 and 1921 agriculture lease agreements; and
WHEREAS, the Department of Hawaiian Home Lands has a fiduciary
responsibility to provide for infrastructure on Hawaiian Home Lands; and
WHEREAS, lessees have relied on agreements with the Department of Hawaiian
Home Lands that infrastructure would be provided in a timely manner; and
WHEREAS, lessees have moved onto agriculture lots awarded them; and
WHEREAS, lessees have built homes or living shelters in which to live in on
their lots; and
WHEREAS, water catchment systems may be a viable alternative to the lessees;
and
WHEREAS, the Department of Hawaiian Home Lands has indicated they aze
unable to fulfill previous infrastructure agreements made between the Department of
Hawaiian Home Lands and lessees.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that it requests the Hawaiian Home Lands Commission and the
Department of Hawaiian Home Lands to re-evaluate its fiduciary responsibility to the
Hawaiian Home Lands Trust and to the beneficiaries of said Trust.
BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit
a copy of this resolution to the Honorable Bruce Babbitt, Secretary of the Interior; the
Honorable Ben Cayetano, Governor of Hawaii; the Members of the Hawaiian Homes
Commission and Mr. Kali Watson, Director of the Department of Hawaiian Home Lands.
