RESOLUTION NO.
RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOTS AND GRANT OF
EASEMENT WITHIN THE KONA VISTA SUBDIVISION FROM GAMREX, INC., TAX
MAP KEYS (3)7-6-21: PORTIONS OF 04, 09, 10, 11, 12, 13 AND 15, TO
THE COUNTY OF HAWAII.
WHEREAS, Gamrex, Inc., a Hawaii corporation, is the
developer of the Kona Vista Subdivision, and the owner of those
certain roadway lots located in North Kona, Hawaii, specifically
identified as Tax Map Keys: (3)7-6-21: Portions of 04, 09, 10,
11, 12 and 13, being more particularly described in Exhibit A and
Lot 15, being more particularly described in Exhibit B, all of
which are delineated on Exhibit C attached hereto; and
WHEREAS, Gamrex, Inc. has constructed all subdivision
improvements as required for final subdivision approval; and
WHEREAS, Gamrex, Inc. has received approval from the County
of Hawaii's Department of Public Works, Department of Water
Supply and the Planning Department for the improvements made to
the subject property, and are desirous of dedicating the subject
parcels to the County of Hawaii for road and drainage purposes;
and
WHEREAS, the subject road and drainage improvements have
been completed according to County of Hawaii standards and are in
acceptable condition for dedication; and
WHEREAS, Section 23-10 of the Hawaii County Code requires
that the acceptance of such road and drainage improvements be in
compliance with Chapter 23 of the subdivision code; and
WHEREAS, Article XIZZ, Section 13-12 of the Hawaii County
Charter, provides that the Council may accept gifts which include
the dedication of land on behalf of the County of Hawaii; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Article XIII, Section 13-12 of the
Hawaii County Charter, and Section 23-10 of the Hawaii County
Code, that the County of Hawaii accepts the dedication deed and
grant of easement for real property identified as Tax Map Keys
(3)7-6-21: Portions of 04, 09, 10, 11, 12, 13 and 15 for road and
drainage purposes.

being Roadway Lota A and B of the "BONA VISTAS SUBDIVISION,
UNIT I-A," as shown on File Plan No. 2084, filed in the Bureau
of Conveyances of the State of Hawaii, and containing areas of
2.295 acres, and 1.956 acres, respectively, more or less.

1st and 2nd, North Rona, Island, County and State of Hawaii,
being Roadway Lota A, B and C of the "KONA VISTAS SUBDIVISION,
UNIT i-B," as shown on File Plan No. 2099, filed in the Bureau
of Conveyances of the State of Hawaii, and containing areas of
1.774 acres, 2.109 acres, and 1.777 acres, respectively, more
or less.
SUBJECT, HOWEVER, to all encumbrances of record.

EASEMENT "R-1", for road and utility purposes, being
a portion of Royal Patent 4475, Land Commission Award 7713,
Apana 43 to Victoria Ramamalu, being also a portion of Lot 3,
and thus bounded and described:
Beginning at the south corner of this easement, being
also the south corner of Lot 3 and along Roadway Lot C, Rona
Vista Subdivision, Unit 1-B (File Plan 2099), the coordinates
of said point of beginninq referred to Government Survey
Triangulation Station "KAILUA", being 10,371.96 feet South and
