A RESOLUTION RELATING TO HOUSE BILL No. 1563 REGARDING NATIVE
HAWAIIAN CULTURAL IMPACT STATEMENTS
WHEREAS, chapter 226-25 (b)(3), Hawaii Revised Statutes, states that proposed public
and private actions shall take into account the effect these actions will have on the culture and
community of the people of Hawaii; and
WHEREAS, plans to develop agricultural, rural, and conservation land use districts
should take into consideration the effects that such development activity would have on the
rights of native Hawaiians and their culture; and
WHEREAS, the use of a cultural impact statement to determine the effects that a
proposed development may have on the specific rights of native Hawaiians would ensure that
these specific rights aze taken into account by the public agencies, whose duties include the
advancement and promotion of public interest and the interests of native Hawaiians and their
culture; and
WHEREAS, in the past, the failure to adequately assess the impact that proposed
developments have on the specific rights of native Hawaiian has often led to litigation in the
courts at the state and federal level; and
WHEREAS, the promotion and protection of the specific rights of native Hawaiians and
their cultural traditions, through the use of cultural impact statements, may serve to reduce the
number of cases which involve litigation in the courts of the state and federal government; and
WHEREAS, H.B. No.1563 would amend the HRS by requiring that proposals to develop
agricultural, rural, and conservation land would require that a native Hawaiian cultural impact
statement be filed; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it supports passage of legislation establishing the use of native Hawaiian cultural
impact statements in considering land development permits.
BE IT FURTHER RESOLVED that the Council has a vaziety of concerns regarding the
implementation measures proposed in H.B. No.1563 and urges careful consideration of the
impacts on small property owners and our agricultural industry.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of
this Resolution to Representative Joseph Souki, Speaker of the House of Representatives;
Senator Norman Mizuguchi, President of the Senate; Representative Dennis Arakaki, Chair of
the Hawaiian Affairs & Housing Committee; Senator James Aki, Chair of the Hawaiian Affairs
Committee; Representative Dwight Takamine, Chair of the Water & Land Use Planning
Committee; Senator Randy Iwase, Chair of the Planning ,Land & Water Use Management
Committee; Representative Calvin K. Y. Say, Chair of the Finance Committee; Senator Donna
Ikeda, Chair of the Ways & Means Committee; and Representative Annelle Amazal.
