RESOLUTION N0. 62 95
RESOLUTION AUTHORIZING THE COUNTY OF HAWAII, PURSUANT TO
SECTION 2-120, HAWAII COUNTY CODE, TO SELL PROPERTY DESIGNATED
AS PARCELS 1 AND 16 (REV. 1), AS SHOWN ON THE RIGHT-OF-WAY MAP
OF HAWAII BELT ROAD, KAMEHAMEHA AVENUE, WAILOA BRIDGE REPLACE-
MENT AND APPROACHES, FEDERAL AID PROJECT NO. BR-019-2(25), AT
PIOPIO, WAIAKEA, SOUTH HILO, ISLAND OF HAWAII, HAWAII, FILED
IN THE HIGHWAYS DIVISION, DEPARTMENT OF TRANSPORTATION, STATE
OF HAWAII.
WHEREAS, the State of Hawaii, Department of Transportation,
has completed the replacement of Wailoa Bridge and approaches;
and
WHEREAS, in consideration of these improvements, the
County of Hawaii had agreed to quitclaim that property to the
State of Hawaii, Department of Transportation; and
WHEREAS, a deed was executed and delivered to the State of
Hawaii, on the 26th day of October, 1987. However, that deed
was not properly acknowledged and therefore rejected by the
Bureau of Conveyances for recording; and
WHEREAS, a new quitclaim deed will now need to be executed
from the County of Hawaii to the State of Hawaii, Department of
Transportation, in order to fulfill the requirements of the
previous deed; and
WHEREAS, in reviewing the past transaction, it is unclear
whether the County Council, pursuant to Section 2-120, Hawaii
County Code, had approved such disposition of property, which
is required in order for the County of Hawaii to dispose of
such property to the State of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that pursuant to Section 2-120, Hawaii County
Code, it approves and authorizes the Director of Finance to
negotiate the disposition of real property identified as
Parcels 1 and 16 (REV. 1), as shown on the Right-of-Way Map of
Hawaii Belt Road, Kamehameha Avenue, Wailoa Bridge Replacement
and Approaches, Federal Aid Project No. BR-019-2(25), at
Piopio, Waiakea, South Hilo, Island of Hawaii, Hawaii, filed in
the Highways Division, Department of Transportation, State of
Hawaii.
