RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A LEASE
WITH FAMILY CRISIS SHELTER, INC., AND AUTHORIZING THE MAYOR TO
EXECUTE A LEASE FOR THE PURPOSE OF OPERATING A SHELTER FOR ABUSED
SPOUSES WITH TERMS TO INCLUDE A MAXIMUM DURATION OF THREE YEARS, AT
A SET RENTAL OF $1.00 PER YEAR.
WHEREAS, pursuant to Chapter 2, Article 19, Section 2-120(x)
(2), Hawaii County Code, as amended, the County Council may direct
the Finance Director to dispose of real property by leasing it to
governments, governmental agencies, non-profit organizations or
affordable housing developers at such rentals and on such terms and
conditions as deemed proper; and
WHEREAS, Chapter 2, Article 19, Section 2-120(b), Hawaii
County Code, as amended, provides that the Council may, by
resolution approved by a majority of its members, direct the Finance
Director to negotiate the disposition of real property by lease to
non-profit organizations at such rentals and on such terms and
conditions as deemed proper; and
WHEREAS, Section 2-73, Hawaii County Code, provides that all
instruments and documents relating to housing programs of the County
Housing Agency shall be signed by the Mayor as authorized by the
Charter and Council; and
WHEREAS, the County Council has expressed the need for a
shelter for abused spouses in this County; and
WHEREAS, the County owns real property that has been used as a
shelter for abused spouses; and
WHEREAS, on November 2, 1983, the County Council adopted
Resolution No. 767-83, which directed the Finance Director to select
a qualified non-profit organization to operate a shelter for abused
spouses and to negotiate a lease with a maximum term of five years
at a set rental of $1.00 per year; and
WHEREAS, pursuant to Resolution No. 767-83, the Finance
Director selected the Family Crisis Shelter, Inc., to operate a
shelter for abused spouses; and
WHEREAS, on November 1, 1989, and June 1, 1994, the County
Council adopted Resolution Nos. 110-89 and 227-94, which directed
the Finance Director to negotiate a lease with the Family Crisis
Shelter, Inc., for the purpose of operating a shelter for abused
spouses with a maximum term of five years, and one year respectively
at a set rental of $1.00 per year; and
WHEREAS, for the past six years, the Family Crisis Shelter,
Inc., has operated a shelter for abused spouses; and
WHEREAS, the Family Crisis Shelter, Inc., desires to continue
to operate a shelter for abused spouses; and
WHEREAS, the County Council desires that Family Crisis
Shelter, Inc., continue its operation of its shelter for abused
spouses.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that the Finance Director is hereby authorized to negotiate
a lease with the Family Crisis Shelter, inc., for the purpose of
operating a shelter for abused spouses with terms to include a
maximum duration of three years, at a set rental of $1.00 per year.
BE IT FURTHER RESOLVED, that the Housing Administrator work
closely with the Finance Director in negotiating the lease agreement.
BE IT FURTHER RESOLVED, that the Mayor or his duly authorized
representative is hereby authorized to execute a lease agreement
with the Family Crisis Shelter, Inc., for the purpose of operating a
shelter for abused spouses with terms to include a maaimum duration
of three years, at a set rental of $1.00 per year.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Office of the Mayor, the Department of Finance
and the Office of Housinq and Community Development.
