HomeMy WebLinkAboutRES 094 Draft 01 1994-1996COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 9¢ 9b RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A LEASE WITH CATHOLIC CHARITIES, AND AUTHORIZING THE MAYOR TO EXECUTE A LEASE FOR THE PURPOSE OF OPERATING A HOMELESS SHELTER FOR HOMELESS FAMILIES AND CHILDREN WITH TERMS TO INCLUDE A MONTH- TO-MONTH LEASE NOT TO EXCEED A MAXIMUM DURATION OF ONE YEAR, AT A SET RENTAL OF $1.00 PER YEAR. WHEREAS, pursuant to Chapter 2, Article 19, Section 2- 120(a)(2), Hawaii County Code, as amended, the County Council may direct the Finance Director to dispose of real property by leasing it to governments, governmental agencies, non-profit organizations or affordable housing developers at such rentals and on such terms and conditions as deemed proper; and WHEREAS, Chapter 2, Article 19, Section 2-120(b), Hawaii County Code, as amended, provides that the Council may, by resolution approved by a majority of its members, direct the Finance Director to negotiate the disposition of real property by lease to non-profit organizations at such rentals and on such terms and conditions as deemed proper without notice or appraisal; and WHEREAS, Section 2-73, Hawaii County Code, provides that all instruments and documents relating to the housing programs of the County Housing Agency shall be signed by the Mayor as authorized by the Charter and the Council; and WHEREAS, Mauna Kea Land Corporation and the Queen Emma Foundation have agreed to provide the project site (TMK: 6-2- 01: Por. 60) to the County for the purpose of developing a temporary homeless shelter project; and WHEREAS, the County has acquired the land through a revocable license, upon which the Kawaihae Homeless Shelter project is located; and WHEREAS, the County developed a 21-unit single family homeless shelter in Kawaihae, South Kohala, Hawaii, identified as TMK: 6-2-01: Por. 60; and WHEREAS, the Kawaihae Homeless Shelter is designed to serve the needs of homeless families with children; and WHEREAS, on September 18, 1991, the County Council adopted Resolution No. 372-91, which directed the Finance Director and Housing Administrator to negotiate lease terms with Catholic Charities; and WHEREAS, Catholic Charities is a certified non-profit organization, which has operated the shelter for the past two years; and WHEREAS, Catholic Charities desires to continue to operate the Kawaihae Homeless Shelter for homeless families; and WHEREAS, the County Council desires that the Kawaihae Homeless Shelter continue its operation for homeless families. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Finance Director and Housing Administrator are hereby authorized to negotiate a lease with Catholic Charities for the purpose of operating a homeless shelter for homeless families and children with terms to include a month-to- month lease not to exceed a maximum duration of one year, at a set rental of $1.00 per year. BE IT FURTHER RESOLVED, that the Housing Administrator work closely with the Finance Director in negotiating the lease agreement. BE IT FURTHER RESOLVED, that the Mayor or his duly authorized representative is hereby authorized to execute a lease agreement with Catholic Charities with terms to include a month- to-month lease not to exceed a maximum duration of one year, at a set rental of $1.00 per year. BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the Office of the Mayor, the Department of Finance and the Office of Housing and Community Development.
