RESOLUTION N0. 9~ ~'
A RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR WATER AND
SEWAGE EASEMENTS AT THE O~OKALA EMPLOYEE HOUSING AREA, HAMAKUA
SUGAR COMPANY, INC., TAX MAP KEY (3)3-9-01-034 TO JOHN T. GOSS,
TRUSTEE OF HAMAKUA SUGAR COMPANY, INC.
WHEREAS, the County of Hawaii is the owner of that certain
lot located in O'okala, Hamakua, Hawaii, specifically identified
as Tax Map Key: (3)3-9-01-034, being more particularly delineated
on Exhibit A (map), said exhibit being a redline survey map
prepared by the Grantee herein and attached hereto; and
WHEREAS, the Grantee herein, John T. Goss, Trustee o~
Hamakua Sugar Company, Inc., needs the Grant of Easement for the
water and sewer easements at the O'okala employee housing area in
order to convey those properties to the Hamakua Housing
Corporation for use of the facilities by the displaced Hamakua
Sugar plantation workers; and
WHEREAS, §2-111 of the Hawaii County Code requires that the
Council, by resolution, authorize the Grant of Easement from the
County of Hawaii, subject, however, to reversion to the County of
Hawaii upon termination or abandonment of the easement for the
specific purposes for which it was granted.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Section 2-111 of the Hawaii County
Code, that the County of Hawaii authorizes a grant of easement
for water and sewer purposes at the O~okala Employee Housing area
as delineated on the redline map submitted by the Grantee, of Tax
Map Key (3)3-9-01-034 until termination or abandonment of that
specific purpose to John T. Goss, Trustee of Hamakua Sugar
Company, Inc., his successor or assigns.
