RESOLUTION REQUESTING THAT THE STATE LAND USE COMMISSION DEFER ANY
DECISION ON BR 94-707 AND THAT IT RE-OPEN PUBLIC HEARINGS TO ALLOW
INPUT FROM OTHER AFFECTED LANDOWNERS AND FARMERS.
WHEREAS, on July 22, 1994, the Office of State Planning filed petition BR 94-707 with
the State of Hawaii Land Use Commission to amend the State land use district boundary by
reclassifying approximately 171.61 acres from agricultural district to conservation district; and
WHEREAS, this land surrounds the Manowaiopae, Kuwaikahi and Kihalani Streams in
the district of North Hilo in the County of Hawaii; and
WHEREAS, the Natural Resources Conservation Service of the U.S. Department of
Agriculture has determined that these streams and their associated gulches along the Hamakua
coast are a critical part of agriculture operations; and
WHEREAS, this petition, if approved, will have a detrimental effect on the development
of diversified agriculture in the region at a time when the development of alternate agriculture
uses of the land is being promoted by the State of Hawaii and the County of Hawaii to mitigate
the economic effect on the Hamakua community caused by the closing of its two sugar
plantations; and
WHEREAS, the Land Use Commission notified and granted intervenor status to only
landowners who had filed a claim for use of the stream waters under the State Water Code; and
WHEREAS, of the two landowners who were served with notice, one landowner chose
to file for intervenor status; and
WHEREAS, other landowners and farmers with landholdings in the azea of the streams
and gulches have not been given the opportunity to be heazd on an issue which will affect current
and future agriculture use of their lands, as well as their agriculture way of life; and
WHEREAS, Land Use Commission has closed the public heazing on BR 94-707 and will
make a decision forthwith.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that it requests that the State Land Use Commission defer any decision on BR 94-707
and that it re-open public heazings to allow input from other affected landowners and farmers.
BE IT FURTHER RESOLVED, that the Council requests the Office of State Planning
and the State Land Use Commission consider the alternative action of working with the
Hamakua Soil & Water Conservation District, the County Administration and adjoining
landowners to establish a locally developed resource management plan meeting the resource
protection objectives of the Office of State Planning.
BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit a copy
of this resolution to the Honorable Benjamin J. Cayetano, Governor of the State of Hawaii, Mr.
Allen K. Hoe, Chairman of the State Land Use Commission, Mr. Gregory Pai, Director of the
Office of State Planning, the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii,
Ms. Virginia Goldstein, Director of the Planning Department and Mr. Thomas Young of
Papaaloa.
