RESOLUTION N0. 12~ ~
WHEREAS, Chapter 2, Article 19, of the~Hawaii County
Code provides that the County Council may, by resolution
approved by the majority of its members, dispose of real
property; and
WHEREAS, the easements and right-of-way granted to
County of Hawaii by various owners of parcels TNIIC:
2-4-10:023, 110, 114 and 124 for the purpose of clearing,
trenching, laying, construction, maintaining and repairing
of a pipeline for a water system for the County of Hawaii;
and
WHEREAS, the Department of Water Supply no longer needs
the three feet wide water distribution pipeline easements
and right-of-way due to water system improvement and,
therefore, would like to terminate the easements and
right-of-way; and
WHEREAS, the owners will accept the cancelled easements
and right-of-way with the understanding that the pipeline
will be abandoned in place;
NOW, THEREFORE, HE IT RESOLVED by the Council of the
County of Hawaii that:
1. in accordance with the provisions of Chapter 2,
Article 19 of the Hawaii County Code, the Director of

Finance be authorized to cancel the easements and
right-of-way for parcels TMK: 2-4-10:023, 110, 114, and 124
located at Waiakea Homestead, South Hilo, Hawaii.
2. The Clerk of the County of Hawaii shall transmit
copies of this resolution to the Department of Water Supply
and the Director of Finance.
