RESOLUTION ACCEPTING THE ROADWAY LOTS WITHIN THE PANIAU
SUBDIVISION FROM THE STATE OF HAWAII, TAX MAP KEYS (3)6-9-001-007
AND 12, 6-9-006-001, 002 AND 049 THROUGH 052, TO THE COUNTY OF
HAWAII.
WHEREAS, the State of Hawaii is the owner of those certain
roadway lots located in Lalamilo, South Kohala, Hawaii,
specifically identified as Tax Map Keys: (3)6-9-001-007 and 12,
6-9-006-001, 002 and 049 through 052, being more particularly
described in Exhibit A and delineated on Exhibit B attached
hereto; and
WHEREAS, Paniau Partners has acquired Land Patent Grant
No. S-15,803 from the State of hawaii for transfer to the County
of Hawaii for the dedicated portions of its subdivision
improvements; and
WHEREAS, Paniau Partners has constructed all subdivision
improvements as required for final subdivision approval; and
WHEREAS, Paniau Partners has received approval from the
County of Hawaii~s Department of Public Works, Department of
water Supply and the Planning Department for the improvements
made to the subject property, and the State of Hawaii is desirous
of selling the subject parcels to the County of Hawaii for road
and drainage purposes; and
WHEREAS, the subject road and drainage improvements have
been completed according to County of Hawaii standards and are in
acceptable condition; and
WHEREAS, Section 23-10 of the Hawaii County Code requires
that the acceptance of such road and drainage improvements be in
compliance with Chapter 23 of the subdivision code; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County
Charter, provides that the Council may accept land on behalf of
the County of Hawaii; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Article XIII, Section 13-12 of the
Hawaii County Charter, and Section 23-10 of the Hawaii County
Code, that the County of Hawaii accepts the real property
identified as Tax Map Keys (3)6-9-001-007 and 12, 6-9-006-001,
002 and 049 through 052 for road and drainage purposes.

Being a portion of Grant 10,559 to Annabelle Ruddle conveyed to
the Territory of Hawaii by Annabelle Ruddle by deed dated
December 4, 1958 and recorded in Liber 3543, Page 462
(Land Office Deed 15594),
Beginning at the southeast corner of this parcel of land, the coordinates
of said point of beginning referred to Government Survey Triangulation Station
PUAKO' being 7173.32 feet South and 9392.71 feet West, thence running by
azimuths measured Clockwise from True South:-
I. 96' 18' 50.00 feet along the remainder of Grant 10,559 to
Annabelle Ruddle;
2. 186' 18' 75.60 fat along the remainder of Grant 10,559 to
Annabelle Ruddle;
3. Thence along the remainder o(Gtant 10,559 to Annabelle Ruddle on a tune to
the right with a radius of 455.00 fat the
chord azimuth and distance being:
190° 18' 63.48 feet;
4. 193° IS' 25.86 fat along the remainder of Grant 10,559 to
Annabelle Ruddle;
5. 320° 40' 62.28 fat along Parcel A of Puako Beach Dri.e
Extension;
6. Thence along the remainder of Grant 10,559 to Annabelle Ruddle on a cunt to
the left with a radius of 405.00 feet, Ute
