RESOLUTION N0. 146 95
RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR ELECTRICAL
UTILITY LINE EASEMENTS AT HOLUALOA, 1ST AND 2ND, DISTRICT OF
NORTH KONA, ISLAND, COUNTY AND STATE OF HAWAII, TAX MAP KEY
NO. (3)7-6-013-017, TO HAWAII ELECTRIC LIGHT COMPANY, INC.
WHEREAS, the County of Hawaii is the owner of that certain
parcel located at Holualoa 1st and 2nd, District of North Kona,
Island, County and State of Hawaii, specifically identified as
Tax Map Key No. (3)7-6-013-017, being more particularly
delineated on Exhibit "A" (map), said exhibit prepared by Hawaii
Electric Light Company, Inc.; and
WHEREAS, Hawaii Electric Light Company, Inc. needs the grant
of easement to install and maintain anchor and guy wire lines and
overhead wire lines within the County's property, and to
maintain, use, operate and repair and remove any fixtures and
appurtenances ther.•ewith; and
WHEREAS, Section 2-111 of the Hawaii County Code requires
that the Council, by resolution, authorize the Grant of Easement
from the County of Hawaii, subject, however, to reversion to the
County of Hawaii upon termination or abandonment of the easement
for the specific purposes for which it was granted.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Section 2-111 of the Hawaii County
Code, that the County of Hawaii authorizes a grant of easement
for the installation and maintenance of anchor guy wires and
overhead wire lines to Hawaii Electric Light Company, Inc., as
delineated on the map submitted by Hawaii Electric Light Company,
Inc. attached hereto, over Tax Map Key No. (3)7-6-013-017, until
termination or abandonment of that specific purpose to Hawaii
Electric Light Company, Inc., its successors or assigns.
