RESOLUTION N0. 1'7a 95
A RESOLUTION RELATING TO FEDERAL TELECONIMUNICATIONS LEGISLATION
WHEREAS, the U.S. Congress has stated that local and state government should be more
empowered to manage those issues which directly impact their respective jurisdiction; and
WHEREAS, the current pro-competitive, de-regulatory telecommunications bills to be
considered in conference committee, H.R. 1555 and S. 652, contain provisions that would
restrict the powers of state and local government to manage telecommunications issues which
may be unique to one specific state or municipality; and
WHEREAS, the current version of H.R. 1555 would preempt local zoning authority over
the placement of cellular towers; and
WHEREAS, the telecommunication market in the State of Hawai' i is not characterized
by competition; and
WHEREAS, GTE Hawaiian Tel monopolizes the local exchange market and controls
ninety-five (95) percent of the intrastate market; and
WHEREAS, rate of return regulation is the primary method used to protect
telecommunications subscribers in the State of Hawai' i; and
WHEREAS, H.R. 1555 and S. 652 would eliminate rate of return regulation as a method
for safeguarding reasonable rates for Hawai' is consumers, leaving consumers with neither a
choice of basic service providers nor regulatory protection at the state level; and
WHEREAS, Hawai' is consumers would be better served if rate of return regulation is
eliminated only after effective competition exists in the state's telecommunications market; and
WHEREAS, Federal telecommunications legislation should seek to provide strong
language which promotes just and affordable rates for basic residential telephone services; and
WHEREAS, Hawai' i, being remote and having many rural areas, would be served by the
preservation of rate integration and geographic averaging policies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it thanks the Hawai' i Congressional delegates for their efforts in addressing the
specific concerns of the County and State of Hawai i with regards to the impact of pending
federal telecommunications legislation.
BE IT FURTHER RESOLVED that the Council respectfully requests that the
Congressional delegates continue their strong efforts to protect the State and County of Hawai' is
interests as the United States Senate and House of Representatives go into conference committee
on S. 652 and H.R. 1555.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawai' i transmit copies
of this Resolution to the Honorable Senator Daniel K. Akaka, the Honorable Senator
Daniel K. Inouye, the Honorable Representative Neil Abercrombie, and the Honorable
Representative Patsy T. Mink.
