RESOLUTION ACCEPTING THE DEDICATION OF A ROADWAY LOT, BEING A
PORTION OF ROAD "C" EXTENSION, THE HIND SUBDIVISION, FROM
ROBERT L. HIND, III, MICHAEL T. HIND AND FRANCIS W. HIND,
SUCCESSOR TRUSTEES, ROBERT L. HIND, III, MICHAEL T. HIND,
JENNIFER L. MITCHELL AND FRANCIS W. HIND, TAX MAP KEY (3)7-6-21:
PORTION OF 08, TO THE COUNTY OF HAWAII.
WHEREAS, ROBERT L. HIND, III, MICHAEL T. HIND and FRANCIS W.
HIND, Successor Trustees of that certain Trust Agreement dated
July 23, 1982, made by Robert Leighton Hind, Jr., as amended;
ROBERT L. HIND, III, husband of Margaret B. Hind; MICHAEL T.
HIND, husband of Pearl L. Hind; JENNIFER L. MITCHELL, formerly
known as Jennifer L. Hind, wife of William R. Mitchell; and
FRANCIS W. HIND, husband of Marilyn E. Hind (hereinafter
collectively called the "Grantors") are the developers of the
Hind Subdivision, and the owners of that certain roadway lot
located in North Kona, Hawaii, specifically identified as Tax Map
Key: (3)7-6-21: Portion of 08, being more particularly described
in Exhibit A and delineated on Exhibit B attached hereto; and
WHEREAS, the Grantors have constructed all subdivision
improvements as required for final subdivision approval; and
WHEREAS, the Grantors have received approval from the County
of Hawaii's Department of Public Works, Department of Water
Supply and the Planning Department for the improvements made to
the subject property, and are desirous of dedicating the subject
parcel to the County of Hawaii for road and drainage purposes; and
WHEREAS, the subject road and drainage improvements have
been completed according to County of Hawaii standards and are in
acceptable ccndition for dedication; and
WHEREAS, Section 23-10 of the Hawaii County Code requires
that the acceptar~be of such road and drainage improvements be .i.n
compliance with Chapter 23 of the subdivision code; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County
Charter, provides that the Council may accept gifts which include
the dedication of land on behalf of the County of Hawaii; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Article XIII, Section 13-12 of the
Hawaii County Charter, and Section 23-10 of the Hawaii County
Code, that the County of Hawaii accepts the dedication deed for
real property identified as Tax Map Key (3)7-6-21: Portion of 08,
for road and drainage purposes.

Land situated at Holualoa 1 & 2, roughly
3,200 feet northeast of the intersection
of Komohana Rai Subdivision and Kuakini
Highway, North Rona, Hawaii
Being a portion of the Holualoa Hui
Lands, a portion of R.P. 4475, L.C. Aw.
7713, Ap. 43 to Victoria Ramamalu
Beginning at the southeast corner of this roadway parcel, on the
northerly side of Lot 14, (as shown on Subdivision Plan dated
February 3, 1976), the coordinates of which referred to Government
Survey Triangulation Station "KAILUA", being 10,989.35 feet south
and 12,829.89 feet East and running by azimuths measured clockwise
from true South:
1. 60° 16' 50.24 feet along Lot 14, (as shown on
Subdivision Plan dated
February 3, 1976);
Thence along a portion of Lot 13-H, on a curve to the right with a
radius of 325.00 feet, the chord azimuth and distance being:
2. 157° 22' 27.5" 22.41 feet;
3. 159° 21' 206.82 feet along same and a portion
of Lot 13-C;
Thence along the remaining portion of Lot 13-C, on a curve to the
right with a radius of 350.03 feet, the chord azimuth and distance
being:
4. 163° 25' 56.5" 49.84 feet;
5. 240° 16' 52.78 feet along 'Iolani Increment 1
Road "C";
Thence along a portion of Lot 13-E and a portion of Lot 13-D, on a
curve to the left with a radius of 300.03 feet, the chord azimuth
and distance being:
6. 344° 55' 37.5" 58.32 feet;
7. 339° 21' 206.82 feet along remaining portion of
Lot 13-D, along Lot 13-F
and along a portion of Lot
13-G;
