PETERS, CHARLES A. KEKUMANO, TRUSTEES OF LILIUOKALANI TRUST, AND MARYL DEVELOPMENT, INC., TAX MAP KEYS (3)7-4-08:001 (PORTION) AND 7-5-04:019, 043 AND 054 (PORTION), TO THE COUNTY OF HAWAII. WHEREAS, FIRST HAWAIIAN BANK, DAVID M. PETERS, CHARLES A. KEKUMANO, TRUSTEES OF LILIUOKALANI TRUST, and MARYL DEVELOPMENT, INC., a Hawaii corporation, are the owners of that certain roadway lot located in North Kona, Hawaii, specifically identified as Tax Map Key: (3)7-4-08:001 (Portion), being more particularly described in Exhibit A and delineated on Exhibit B attached hereto; and WHEREAS, MARYL DEVELOPMENT, INC., a Hawaii corporation, is the owner of that certain roadway lot located in North Kona, Hawaii, specifically identified as Tax Map Keys: (3)7-5-04:019, 043 and 054 (Portion), being more particularly described in Exhibit C and delineated on Exhibit D attached hereto; and WHEREAS, FIRST HAWAIIAN BANK, DAVID M. PETERS, CHARLES A. KEKUMANO, TRUSTEES OF LILIUOKALANI TRUST, and MARYL DEVELOPMENT, INC. have constructed all subdivision improvements as required for final subdivision approval; and WHEREAS, FIRST HAWAIIAN BANK, DAVID M. PETERS, CHARLES A. KEKUMANO, TRUSTEES OF LILIUOKALANI TRUST, and MARYL DEVELOPMENT, INC. have received approval from the County of Hawaii's Department of Public Works, Department of Water Supply and the Planning Department for the improvements made to the subject property, and are desirous of dedicating the subject parcels, more commonly referred to as the Henry Street Extension, to the County of Hawaii for road and drainage purposes; and WHEREAS, the County of Hawaii has entered into an agreement with Maryl Development to initiate condemnation proceedings for that piece of the Henry Street Extension, identified as Tax Map Key (3)7-5-03-021 (Portion), aka the Rapoza Triangle, which would link the above two parcels and complete the Henry Street Extension; and WHEREAS, the subject roads and drainage improvements have been completed according to County of Hawaii standards and are in acceptable condition for dedication; and WHEREAS. Section 23-10 of the Hawaii County Code requires that the acceptance of such roads and drainage improvements be in compliance with Chapter 23 of the subdivision code; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts which include the dedication of land on behalf of the County of Hawaii; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication deeds for real property identified as Tax Map Keys (3)7-4-08:001 (Portion) and 7-5-04:019, 043 and 054 (Portion) for road and drainage purposes.
