RESOLUTION N0. ~~`~ 96
WHEREAS, Ordinance 94-86 defines 'special duty' as the
performance of a service by an officer of the Hawaii County Police
Department acting in a police capacity, in return for which the
officer receives a direct or indirect payment or compensation of
some kind; and
WHEREAS, Ordinance 94-86 also provides that an administrative
fee shall be assessed in addition to any charge assessed for the
services of the special duty police officer; and
WHEREAS, Ordinance 94-86 places the responsibility for the
administration of the processing of requests for the 'special duty'
services on the chief of police; and
WHEREAS, any person or entity requesting the services of a
special duty police officer shall be assessed an administrative fee
in accordance with the rules established by the Chief of Police; and
WHEREAS, an Account Clerk, SR-11 position would be critical to
facilitate special duty operations island-wide in response to the
adoption of Ordinance No. 94-86; and
WHEREAS, Article V, Section 5-1.3(c) of the Hawaii County
Charter states that the Mayor has the power to "Create
positions...for which appropriations have been made by the
council...";
WHEREAS, this position would be funded by the administrative
fees assessed for special duties requests.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that an Account Clerk, SR-11 position be created.
BE IT FURTHER RESOLVED that a Copy of this resolution be
transmitted to the Departments of Finance and Police.
