RESOLUTION N0. ~'-~8 °.JS
PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTIES FOR THE
EXTENSION OF PUNAHOA STREET, DISTRICT OF SOUTH HILO, COUNTY AND
STATE OF HAWAII.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, traffic and business within the lower downtown area
has increased in recent years; and
WHEREAS, Punahoa Street, between Mamo Street and Furneaua
Lane, which currently deadends, would provide a vital link to help
alleviate traffic within the lower downtown area; and
WHEREAS, to extend Punahoa Street between Mamo Street and
Furneaua Lane would entail the acquiring of Lot 10 (Tax Map Key
No. (3)2-3-08:010) and Lot 11-A (Tax Map Key No. (3)2-3-08:009
Portion); and
WHEREAS, the County deems it necessary to exercise its right
of eminent domain in acquiring those certain private properties to
complete the Punahoa Street extension to provide for a continuous
road from Mamo Street to Furneaua Lane; and
WHEREAS, Section 101-13 of the Hawaii Revised Statutes
requires that a condemnation action by the County must be
authorized by a resolution of the County Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that it is necessary for the public use and purpose, to
wit: the continuation and improvement of the Punahoa Street
Extension, situate at Punahoa, District of South Hilo, County and
State of Hawaii, to take, acquire and condemn those certain
private properties identified as Taa Map Key Nos. (3)2-3-08:010
and 2-3-08:009 (portion), described in Exhibit "A" attached hereto
and made a part hereof by reference.
BE IT FURTHER RESOLVED that the Corporation Counsel of the
County of Hawaii be and is hereby authorized and empowered to
initiate proceedings in eminent domain, as provided by law, for
the taking, acquisition and condemnation of the aforesaid private
properties, together with any adjacent private properties
necessary for temporary construction purposes.
BE IT FURTHER RESOLVED that in the process of said
proceedings in eminent domain, the Corporation Counsel be and is
hereby authorized and empowered to negotiate terms of settlement,
subject to the approval of the court before which such proceedings
are prosecuted.
Stephen K. Yamashiro, Mayor of the County of Hawaii, the Chief
Engineer of the Department of Public Works, and the Office of the
Corporation Counsel.
HE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
is directed to transmit copies of this Resolution to the Honorable

Lot 10, Map 1, as filed in the Land Court of the State of
Hawaii. Map and description with Application No. 684 (amended).
Land situated on the Southwest side of Kamehameha Avenue, between
Haili and Mooheau Streets, at Punahoa, Hilo, Hawaii, State of
Hawaii. Beinq a portion of R.P. 2176 to E. Kahakumakalina, and
divided into lots 1 to 17 (inclusive). (Lot 10 encompasses an
approximate land area of 504 sq. ft.)
Lot 11-A, Map 3, as filed in the Land Court of the State of
Hawaii. Subdivision of Lots 6, 7, 8, 9 and 11 of Land Court
Application No. 884 as shown on Map 1, filed in the Office of the
Assistant Registrar of the Land Court into Lots 6-A, 6-B, 7-A,
7-B, 8-A, 8-B, 9-A, 11-A and 11-B. (Lot 11-A, encompasses an
approximate land area of 1,844 sq. ft.)
