RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOT WITHIN THE
KULA RIDGE SUBDIVISION, PHASE I, FROM DARON DALE TONG, BRADLEY
DUNN TONG, LOWELL DEAN TONG, COREY DONN TONG, DONALD S. TONG,
TRUSTEE, AND LEANORA I. TONG, TRUSTEE, TAX MAP KEY (3)2-4-03:028,
TO THE COUNTY OF HAWAII.
WHEREAS, DARON DALE TONG, BRADLEY DUNN TONG, LOWELL DEAN
TONG, COREY DONN TONG, DONALD S. TONG, Trustee under that certain
unrecorded Trust Agreement dated March 24, 1983, and LEANORA I.
TONG, Trustee under that certain unrecorded Trust Agreement dated
March 24, 1983 (hereinafter "Tongs"), are the developers of the
Kula Ridge Subdivision, Phase I, and the owners of that certain
roadway lot located at Waiakea Homesteads, South Hilo, Hawaii,
specifically identified as Tax Map Key: (3)2-4-03:028, being more
particularly described in Exhibit "A" and delineated on
Exhibit "B" attached hereto; and
WHEREAS, the Tongs have constructed all subdivision
improvements as required-for final subdivision approval; and
WHEREAS, the Tongs have received approval from the County of
Hawaii's Department of Public Works, Department of Water Supply
and the Planning Department for the improvements made to the
subject property, and are desirous of dedicating the subject
parcel to the County of Hawaii for road and drainage purposes; and
WHEREAS, the subject road and drainage improvements have
been completed according to County of Hawaii standards and are in
acceptable condition for dedication; and
WHEREAS, Section 23-10 of the Hawaii County Code requires
that the acceptance of such road and drainage improvements be in
compliance with Chapter 23 of the subdivision code; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County
Charter, provides that the Council may accept gifts which include
the dedication of land on behalf of the County of Hawaii; and
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, in accordance with Article XIII, Section 13-12 of the
Hawaii County Charter, and Section 23-10 of the Hawaii County
Code, that the County of Hawaii accepts the dedication deed for
real property identified as Taz Map Key (3)2-4-03:028 for road
and drainage purposes.
