A RESOLUTION SUPPORTING A COUNTY MANDATE COORDINATOR FOR
NACo'S MANDATE COST ESTIMATION PROGRAM.
WHEREAS, county leaders and state associations of counties worked effectively with
the National Association of Counties (NACo) in launching a massive public relations and
lobbying campaign that generated grass-root support for mandate relief legislation, which led to
the passage of the Unfunded Mandates Reform Act, signed by the President on March 22, 1995,
and took effect January 1, 1996; and
WHEREAS, during the last two decades, unfunded federal mandates have forced the
County of Hawaii, like many other states and local governments across the nation, to spend an
increasing share of its budget on federal requirements; and
WHEREAS, under the new law, before a vote is taken on the House and Senate floor,
cost estimate must be prepared for any new mandate expected to cost state and local
governments $50 million or more annually; and Congress must either provide funds to pay for
such a mandate or impose the cost on state and local governments by getting a majority vote in
both houses to waive these requirements; and
WHEREAS, NACo considers the passage of the legislation a significant victory for state
and local governments but warns that this is merely the first phase of the campaign to stop
unfunded federal mandates and that counties must now work with NACo to establish a sound
data base that can be used to help ensure accurate cost estimates on future federal mandates; and
WHEREAS, NACo is asking counties to participate in its mandate cost estimation
program by passing a resolution indicating a willingness to participate and by designating a
mandate coordinator who could be responsible for providing NACo cost data on proposed
federal mandates.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAH that it expresses its firm support for NACo's mandate cost estimation program
and requests that all departments and agencies of the county to cooperate with the county's
mandate coordinator in collecting the necessary cost data on proposed federal mandates targeted
by NACo.
BE IT FURTHER RESOLVED that it requests that the mayor appoint someone from
within the administ>;ation to the position of mandate coordinator who is then hereby requested to
complete the appropriate forms to notify NACo of the county's willingness to participate in its
program and provide the necessary data on proposed federal mandates at the appropriate time
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies
of this resolution to the Honorable Stephen Yamashiro, Mayor of the County of Hawaii; Mr.
Doug Bovin, President of NACo; Ms. Rene Mansho, President of HSAC; and all county
department and agency heads.
