RESOLUTION N0. 308 96
RESOLUTION AUTHORIZING AN AGREEMENT REQUIRING THE PAYMENT OF FUNDS
OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR TO FURNISH
AND MAINTAIN RENTAL GOLF CARTS AT THE HILO MUNICIPAL GOLF COURSE
FOR THE DEPARTMENT OF PARKS AND RECREATION.
WHEREAS, the Department of Parks and Recreation is currently
in the process of formally bidding and selecting a concessionaire
to furnish and maintain rental golf carts at the Hilo Municipal
Golf Course; and
WHEREAS, the Department wishes to execute an agreement with a
maximum term of six years to furnish and maintain rental golf
carts at the Hilo Municipal Golf Course because of the substantial
financial investment required by potential bidders for the
contract; and
WHEREAS, it is in the best interest of the County to obtain
an agreement for a maximum term of six years to furnish and
maintain rental golf carts at the Hilo Municipal Golf Course; and
WHEREAS, Article X, Section 10-11 of the Hawaii County
Charter, requires that any contract, lease or other obligation
requiring the payment of funds from the appropriations of a later
fiscal year or of more than one fiscal year shall be made or
approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that in accordance with Article X, Section 10-11 of the
Hawaii County Charter, the Department of Parks and Recreation is
authorized to execute an agreement to furnish and maintain rental
golf carts at the Hilo Municipal Golf Course for the Department of
Parks and Recreation requiring the payment of funds of a later
fiscal year and of more than one fiscal year.
