RESOLUTION
WHEREAS, Section 10-11 of the County Charter requires that any
contract, lease, or other obligation requiring payment of funds from
the appropriations of a later fiscal year or more than one fiscal
year be approved by resolution; and
WHEREAS, the County of Hawaii desires to lease office space of
approximately 4,896 square feet in the Kealakekua Business Plaza,
Kealakekua, Hawaii; and
WHEREAS, the Office of the Prosecuting Attorney, West Hawaii
Branch, will occupy said space at the cost of $5,963.67 a month; and
WHEREAS, the County wishes to enter into a multi-year lease with
Hawaii State Enterprises, Limited, for five (5) years ending on June
30, 2001, with an option to renew for another five (5) year period,
rents to be negotiated at fair market value or by arbitration.
NOW, THEREFORE, BE IT RESOLVED by the Council of the County of
Hawaii that sufficient funds be budgeted in future fiscal years to
cover the obligations of the County under said lease agreement.
BE IT FURTHER RESOLVED that the Clerk transmit copies of this
resolution to the Department of Finance and the Office of the
Prosecuting Attorney.
