RESOLUTION N0. 334 9S
WHEREAS, Chapter 2, Article 19, Section 2-111, of the
Hawaii County Code provides that the County Council may,
by resolution approved by a majority of its members,
dispose of real property; and
WHEREAS, the County of Hawaii is the owner of
abandoned roadway site, located at Kalopa, Hamakua,
Hawaii, designed by TNIIC: 4-4-08; and
WHEREAS, GTE Hawaiian Telephone is requesting to
acquire easement rights over said County-owned parcel for
the purpose of constructing and installing a pair gain
device/cross connect cabinet to serve the growing Hamakua
district; and
WHEREAS, according to GTE Hawaiian Telephone, the
construction of the pair gain/cross connect cabinet will
provide additional lines and improve the quality of
service to its customers; and
WHEREAS, easement 1 contains 750 square feet for
telephone equipment purpose and easement 2 contains 3,104
square feet for telephone line purpose (see attached map)
for a total of 3,854 square feet; and
WHEREAS, the appraised estimated market value by an
independent certified appraiser was One Thousand Nine
Hundred Twenty Eight dollars ($1,928); and
WHEREAS, the Corporation Counsel will be assisting the
Department of Finance to prepare the easement agreement;
and
WHEREAS, the Department of Public Works has reviewed
the request and finds that it does not have a need for
this abandoned roadway site;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
County of Hawaii that:
1. in accordance with the provisions of Chapter 2,
Article 19, Section 2-111, of the Hawaii County Code, the
Director of Finance be authorized to negotiate and execute
a grant of easement to GTE Hawaiian Telephone for the
purpose of constructing and installing a pair gain
device/cross connect cabinet to serve the growing Hamakua
district.
2. The Clerk of the County of Hawaii shall transmit
copies of this resolution to GTE Hawaiian Telephone,
Department of Public Works and the Director of Finance.
