RESOLUTION AUTHORIZING THE EXCHANGE OF REAL PROPERTY WITH DONN W.
CARLSMITH, PARCEL B, TAX MAP KEY (3)2-7-10:021, AND DISPOSAL OF
REMNANT PARCEL A, TAX MAP KEY (3)2-7-10:021.
WHEREAS, Donn W. Carlsmith is the owner of real property at
Onomea, South Hilo, specifically identified as Parcel B, Tax Map
Key (3)2-7-10:021; and
WHEREAS, the County of Hawaii wishes to create a new roadway
alignment across Parcel B for the 40-foot road right-of-way,
which is located on the access road to the Onomea arch lookout
site; and
WHEREAS, this new alignment would provide for safer and
straighter alignment-for the roadway; and
WHEREAS, Donn W. Carlsmith has agreed to exchange Farcel B
for the remnant piece, which is the old alignment and which is
described as Parcel A, Tas Map Key (3)2-7-10:021; and
WHEREAS, the exchange of real property, while not equal in
value, is advantageous to the County of Hawaii in that it will
provide a shorter, better and safer road design. It may also
reduce maintenance costs and possible future claims of liability;
WHEREAS, Section 2-111 of the Hawaii County Code permits the
exchange of real property for private property and Section 2-118,
Hawaii County Code, allows for the disposal of rem:iant parcels.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that in accordance with Section 2-111 of the Hawaii
County Code, the County of Hawaii accepts the real property
identified as Parcel B, Taz Map Key (3)2-7-10:021, consisting of
22,241 square feet, or .511 acre, from Donn W. Carlsmith, in
ezchange for the remnant parcel, identified as Parcel A, Taz Map
Key (3)2-7-10:021, containing an area of 37,728 square feet, or
.866 acre, which it authorizes the disposal of.
