HomeMy WebLinkAboutRES 352 Draft 01 1994-1996COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 352 96 A RESOLUTION RELATING TO A COUNCIL INITIATED WATER IMPROVEMENT DISTRICT FOR THE KONA COASTVIEW AND KONA WONDERVIEW SUBDIVISIONS. WHEREAS, on January 26, 1994 the Hawaii County Council adopted Resolution No. 149-93, relating to the construction of permanent improvements to the Kona Coastview and Kona Wonderview subdivisions in North Kona, County of Hawaii, including the improvements of the water distribution system to county standards, in accordance with Chapter 12 of the Hawaii County Code relating to improvements by assessments; and WHEREAS, Resolution No. 149-93 directed the chief engineer of the county to prepare and submit a report to the council, containing certain information as specified in the resolution; and WHEREAS, Ordinance No. 95-22, approved by Mayor Stephen Yamashiro on February 9, 1995, amended Chapter 12 of the Hawaii County Code to direct the water manager to prepare and submit the report in the case of a water improvement district; and WHEREAS, the council received the report (Communication No. 1216) from the water manager on May 31, 1996, and does hereby attach hereto and incorporate by reference such surveys, plans, maps and other data contained therein as part of this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it proposes the making of an improvement or improvements, specifying: 1) The special improvements shall be for the design and installation of a water system for the Kona Coastview and Kona Wonderview subdivisions meeting Department of Water Supply standards. 2) The area, owners, so far as known, and general description and location of new land to be acquired are: a) A portion of a 3.13 acre parcel owned by Ellen Garver and identified by Tax Map Key No. 7-3-05:301ocated at the 1,628 foot elevation. b) A portion of a 2.00 acre parcel owned by Robert and Elaine Chapman identified by Tax Map Key No. 7-3-05:96 located at the 1,165 foot elevation. Only .25 of an acre will be required of each parcel as a reservoir site. 3) The materials proposed to be used are as indicated in the water manager's report. 4) The proposed method of assessment shall be one assessment per lot with the minimum number of installments allowed being one, if made prior to the floating of the assessment bonds. 5) The maximum term of the assessment bonds to be issued to represent unpaid installments shall be no more than 20 years. 6) The maximum rate of interest to be borne by the bonds shall be no more than 10.5%. 7) The maximum premium to be paid on the advance payment of installments or the call and redemption of any bond prior to its maturity shall not exceed 5%. 8) The maximum amount of the reserve fund as set forth in the water manager's report shall not exceed 14% of construction cost. 9) The general boundaries of the district to be assessed shall include all the existing lots of the Kona Coastview and Kona Wonderview subdivisions and are contained in Tax Map Key Nos. 7-3-13, 14, 15, ]6, 22, 23 and 28. 10) The maximum estimated units of assessment shall be 422. BE IT FURTHER RESOLVED that a public hearing on the proposed improvements shall be held not more than 60 days after the adoption of this resolution and not less than fifteen days after the first publication of notice thereof in a newspaper of general circulation in the County. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii shall cause notice of the public hearing and mail similar notice of the public hearing by certified letter to all land owners of land proposed to be assessed as set forth in Section 12-] 0 (e) of the Hawaii County Code. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to Mayor Stephen K. Yamashiro and Water Manager Milton Pavao. D~ yIAY 3 1 '996 WATER SYSTEM INSTALLATION COST ESTIMATE FOR IMPROVEMENT DISTRICT Kona Coastview & Kona Wonderview Subdivisions INTRODUCTION This Improvement District is being initiated by the Council for the design and installation of a water system for the Kona Coastview and Kona Wonderview subdivisions meeting the Department of Water Supply standards. This system once completed will be conveyed to the Department for operation and maintenance. IMPROVEMENT DISTRICT BOUNDARIES The boundary of this improvement district includes all the 422 er.isting lots of the Kona Coastview and Kona Wonderview subdivisions are contained in tax map keys 7-3-13. 14. 15 16. 22. 23, and 28. Existing parcels that have their services located along Mamalahoa Highway will be also be included in this district. As a condition of this project. these services along the highway will have to be relocated and reconnected to the new system. WATER SYSTEM IMPROVEMENT REQUIREMENTS The water system improvements, to be built in conformance with the Depatment's Water System Standards (Volumes 1 & 2) will include. but not be limited to the following: 1. 2 - .10 million gallon concrete reservoirs 2. 14,900 lineal feet 6-inch ductile iron pipeline 3. 9.200 lineal feet 8-inch ductile iron pipeline 4. 3 - Pressure reducing valves (PRV) 5. 33 - fire hydrants 6. 211 Type "C" service laterals. Further. the cost of surveying, system design and purchasing the two reservoir sites will be the responsiblity of the assessees. TOTAL COST AND PROPOSED METHOD OF ASSESSMENT The-total estimated improvement district cost is $5.8 million (Table 1) that shall be borne entirely by the assessees either through a bond issue or full payment. The County would be responsible for coordinating and facilitating the bond issue procedure and administering the collection of funds to amortize the debt service. Assessment of the total ccst wi'1 be divided eGuaily among all the lot o~,~ners.
