RESOLUTION
WHEREAS, on July 18, 1996, pursuant to Section 15-1(a) of the Hawaii County Charter (1991),
the Council of the County of Hawaii adopted Bill No. 273, Draft 2 after three readings on sepazate days, by
the affirmative vote of no less than two-thirds of its entire membership; and
WHEREAS, Bill No. 273, Draft 2 proposes to amend Section 13-1 of the Hawaii County Charter
(1991) by stating that as long as an elected County official fulfillshis/her duties to the office, there is no
reason to force the elected official to vacate that office simply because papers are filed to run for another
office which begins after that respective tenn ends; and
WHEREAS, pursuant to Section 15-2 of the Hawaii County Charter (1991), upon adoption of an
ordinance proposing amendments or revisions to the charter, the council shall provide by resolution that
the full text of the proposed amendments or revisions be published in at least two daily newspapers of
general circulation in the county at least forty-five days prior to submission to the electors of the county;
and
WHEREAS, pursuant to Section 11-119(b) of the Hawaii Revised Statutes, whenever the chief
election officer is responsible for the printing of the ballots, the exact wording to appeaz thereon,
including, but not limited to, questions and issues shall be submitted to the chief election officer of the
state no later than 4:30 p.m. on the sixtieth calendaz day prior to the applicable election.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that it hereby directs the Clerk of the County of Hawaii to take the necessary steps provided for in Section
15-2 of the Hawaii County Charter (1991) and to submit the amendments proposed by Hawaii County Bill
No. 273, Draft 2 upon its approval by the Mayor to the electors of the county at the next general election.
BE IT FURTHER RESOLVED that copies of this resolution be sent to Dwayne D. Yoshina, Chief
Election Officer of the State of Hawaii and the Clerk of the County of Hawaii.
