RESOLUTION N0. 3$$ AR
RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE
WITH THE HAWAII ISLAND COPR+IUNITY DEVELOPMENT CORPORATION
FOR THE SALE OF THE OULI ELUA AFFORDABLE HOUSING PROJECT
SITE.
WHEREAS, pursuant to Chapter 2, Article 19,
Section 2-120, Hawaii County Code, as amended, the County
Council may direct the Finance Director to dispose of real
property in fee, by lease, license, or permit; and
WHEREAS, Chapter 2, Article 19, Section 2-114 (a),
Hawaii County Code, as amended, provides that real property
may be sold through negotiation upon a finding by the
Council that the public interest demands it; and
WHEREAS, Chapter 2, Article 19, Section 2-120 (b),
Hawaii County Code, as amended, provides that a disposition
of real property to non-profit organizations or affordable
housing developers may be made without the required notice
or appraisal; and
WHEREAS, the County of Hawaii agrees to sell the
project site (TMK: 6-2-01: A-2) to the Hawaii Island
Community Development Corporation (HICDC), a duly formed
not-for-profit corporation under IRS Section 501(c)(3) for
the purpose of developing mutual self-help housing project;
and
WHEREAS, the County proposes to enter into an Agreement
with the HICDC after receiving proper authorization from the
Hawaii County Council; and
WHEREAS, the Agreement will state that the HICDC will
have approximately two (2) years to complete the
construction of improvements for the development of
approximately twenty (20) single family house lots; and
WHEREAS, the Agreement will further state that the
HICDC will have approximately four (4) years to complete the
construction of improvements for the additional development
of approximately twenty (20) single family house lots for a
total of approximately forty (40) single family house lots;
and
WHEREAS, the Agreement will further state that the
County will purchase the HICDC fee simple interest in the
project site or any remaining portions of the site not
developed by the HICDC or if the HICDC fails to develop any
of the approximately forty (40) single family house lots;
and
WHEREAS, the County hereby acknowledges that the Ouli
area is a good and proper choice for housing development and
construction; and
WHEREAS, the County desires to use its resources to
provide decent, safe and sanitary housing to qualified
families; and
WHEREAS, the County and the HICDC mutually desire to
develop affordable single family homes for sale to families
with income levels of 120 percent (120) and below of the
median family income for the County of Hawaii; and
WHEREAS, it is the intent of the County of Hawaii to
sell the project site to the HICDC for TWO HUNDRED THOUSAND
DOLLARS (5200,000.00) consideration; and
WHEREAS, it is the intent of the HICDC to purchase the
project site from the County of Hawaii for TWO HUNDRED
THOUSAND DOLLARS (5200,000.00) consideration; and
WHEREAS, pursuant to Chapter 2, Article 19,
Section 2-110 (a)(5), Hawai'i County Code, as amended, the
Housing Administrator has certified that the Developer is an
"Affordable Housing Developer"; and
NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY
COUNCIL OF THE COUNTY OF HAWAII, that the Finance Director
and Housing Administrator are hereby directed to negotiate
the sale of the Ouli Elua project site with the Hawaii
Island Community Development Corporation to further the
development of the Ouli Mutual Self-Help housing project.
BE IT FURTHER RESOLVED, pursuant to Chapter 2,
Article 19, Section 2-114 (a), Hawaii County Code, as
amended, the Hawaii County Council finds that it is in the
public interest to authorize the Finance Director to dispose
of 11.25 acres of real property known as the Ouli Elua
project site, further described as TMK: 6-2-01: A-2, through
negotiation with the Hawaii Island Community Development
Corporation.
BE IT FURTHER RESOLVED, pursuant to Chapter 2,
Article 19, Section 2-120 (b), Hawaii County Code, as
amended, the Finance Director is authorized to dispose of
the ouli Elua project site, further described as
TMK: 6-2-01: A-2, without the required notice or appraisal.
BE IT FURTHER RESOLVED, that a copy of this resolution
be transmitted to the Department of Finance and the Office
of Housing and Community Development.
