AN ORDINANCE AMENDING SECTION 23-60, CHAPTER 23 (SUBDIVISIONS), HAWAII COUNTY CODE, AS AMENDED, RELATING TO APPLICATION FEES FOR SUBDIVISION PLANS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to increase the filing fee for subdivision applications since the current fee structure is inadequate to cover the cost of processing the applications and other related expenses such as the drafring of the subdivided lots on the Tax Map Plat sheets. The County has assumed the function and responsibility for the plotting of approved subdivision lots and all other amendments to Tax Map Plat sheets effective July 1, 1998. SECTION 2. Section 23-60 of Chapter 23 (Subdivisions), Hawaii County Code, is amended to read as follows: "Section 23-60. Application fees for subdivision plans. (a) Each application for a subdivision (including consolidatiogl is subject to the payment of the following fee: [$15 plus $3] ~~pl ~ per lot noted on the initial preliminary plat or cluster plan development and for each additional lot resulting from any subsequent amendment of the initial preliminary plat exclusive of any lots set aside fot roadway or easement purposes or lands dedicated for public use. (b) These fees shall not apply to subdivision of land into burial or crematory lots within the confines of duly established cemetery azeas; provided that a processing fee will be filed as follows: $100 per acre and proportionate fee for fraction of acre thereof. (c) The payment of the filing fee shall be made at the planning depaztment's office and payable to the director of finance. No portion of the fee is refundable for applications granted tentative subdivision approval. A portion of fee equivalent to ten percent of the fee or [$5] ESQ, whichever is greater, shall be retained for applications which have been withdrawn or denied before granted tentative approval. " SECTION 3. Material to be deleted is bracketed. New material is underscored. In printing this ordinance, brackets, bracketed material, and underscoring may be deleted. SECTION 4. This ordinance shall take effect upon approval.
