Home My WebLink AboutRES 038 Draft 01 1992-1994COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 3@ 93 WHEREAS, the County is the owner of that certain parcel of land situated at Pepeekeo and Makahanaloa, South Hilo, said parcel being more particularly described in Exhibit "A," attached hereto and made a part hereof; and WHEREAS, said county property is subject to a perpetual non-exclusive easement in favor of Mauna Kea Sugar Company, for road and utility purposes, said easement being more particularly described in Exhibit "B," attached hereto and made a part hereof; and WHEREAS, Big Island Broadcasting Company, Ltd., hereinafter referred to as "Big Island Broadcasting" is the owner of a radio communications facility, consisting of a tower and building, located within said easement area which serves as a FM transmitting site for their operations, and also as a two-way radio site for Mauna Kea Sugar Company; and WHEREAS, Big Island Broadcasting, dba KIPA-AM and KHWI-FM, is the civil defense station-designate for the County of Hawaii, and in that capacity, is housing a county-owned standby generator at the subject radio communications facility; and WHEREAS, having never properly received the necessary easement rights from the County, Big Island Broadcasting, is now desirous of obtaining such rights to the subject county-owned property; and WHEREAS, §2-111 of the Hawaii County Code requires that any grant of interest of real property owned by the county must be authorized by resolution of the County Council; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the, Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii is hereby authorized to execute a grant of easement in favor of Big Island Broadcasting Company, Ltd., for the purpose of allowing them to maintain and operate a radio. communications facility at the hereinabove described county-owned property. BE IT FURTHER RESOLVED, that the Clerk of the County of Hawaii transmit copies of this resolution to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii, and to Hugh E.
